KANSAS CITY, Kan. -- A case involving a flight attendant's twist on a rhyme has ended up in court.

Lawsuit Over 'Racist' Rhyme Goes To Jury

Judge Kathryn H. Vratil ruled last year that the case could proceed to trial, which began and ended Tuesday before an eight-member jury.

But a jury says Southwest Airlines is not responsible for a comment by one of its flight attendants that offended two black passengers.

Jurors in Kansas City decided Southwest is not liable after a flight attendant used a rhyme to urge people to take their seats.

The Southwest Airlines flight from Las Vegas to Kansas City was waiting to depart, when flight attendant Jennifer Cundiff tried to jolly passengers out of the aisle.

Over the intercom, the Argyle, Texas, attendant announced: "Eenie, meenie, minie moe; pick a seat, we gotta go."

A lawyer for the two siblings said they were humiliated and degraded almost three years ago when the attendant said the rhyme. The women say the phrase reminded them of a racist version of the rhyme, which includes the "n-word."

The airline says the flight attendant was unaware of the racist version of the rhyme -- and was directing it at the two women and others who hadn't yet taken their seats.

Plaintiffs Louise Sawyer and Grace Fuller of Johnson County, Kan., say they suffered physical and emotional distress. Their lawyer told the eight-member jury the two were discriminated against -- even though the "n-word" sometime associated with the rhyme was not used.

Cundiff says she had no idea why the rhyme would have been considered racist. She says it was directed at all those who weren't seated, not just Sawyer and Fuller. And she says she'd used it before on other flights, in an attempt at humor. Cundiff said didn't know its history, and didn't mean to offend anyone.

The women decided to sue out of frustration after Southwest Airlines would not take their complaint seriously.

I don't think it's a repost, I do remember the original thread about the case. Glad to hear those two gold-diggers didn't get any cash to mend their hurt feelings.

Now I hope they make them pay out the ass for the cost of the trial, attorney fees, etc.
 
i understand the persons anger, but still, she didnt use it in the improper sense, and because someone in the past put a terrible spin on what was once a innocent nursery rhyme, she gets sued? even though she was misinformed that there were other variants of it? does anyone else think this may just be another frivolous lawsuit?

well, its still going to court. but they cant take action against the airline (which im supposing they named in the suit because southwest no doubt has deep pockets). but the door is still open and they may pursue it to go after the flight attendant.

I looked for the original thread, but couldn't find it. They were trying to say that the racist version of the rhyme was the "original," but someone in the thread proved that the rhyme actually originated in the Middle Ages, and was not racist in its intent.

well, its still going to court. but they cant take action against the airline (which im supposing they named in the suit because southwest no doubt has deep pockets). but the door is still open and they may pursue it to go after the flight attendant.

thank you for digging that information up. i went out on a limb there to say it originated as an innocent rhyme, and thanks for backing up that claim! i figured it didnt start out offensive, or else that rhyme would be more shunned upon when i was growing up and i constantly heard the rhyme from parents and friends. 😀

I had (of course) heard the rhyme when I was younger, and it wasn't until I was 19 that I learned what the rhyme originally was.

Yea, just at first seems like an ignorant comment. But maybe not, dont know why im ultra sensitive today. Maybe its cause i am working my 2nd job tonite. Wont get home till midnite

i agree. just because they got frustrated because their complaint was ignored, they decided to sue? what ever happened to writing a letter to corporate and demanding an apology? but nope, greed appears to be the motive in this attack, and as i stated before, this is borderline if not the definition of a frivolous lawsuit, and its tax money being thrown away.
