Son of a...! Car crashed during warranty repair!

First off, some sore employees but no major injuries.

I had a CEL that ended up being emissions based so I dropped my car off at the local BMW dealer the other day. Got a very cryptic call this afternoon "...This is the service manager at xxx, please call me as soon as possible.". Ok, wtf, that sounds ominous. I call back and find out that during the test drive to repair the issue (Failed SCR meter valve, btw) the service advisor and tech were doing the test run and were T-boned not 500 feet from the dealer. :'(

They took off from a green light and got smacked by someone blowing the light. Luckily there were cameras and such to corroborated the story, plus an ambulance was at the light as well and witnessed the entire thing.

I took a trip to see the damage today. The driver saw what was happening and floored it, so the rear quarter took the hit. The rear fender is gone, bumper, electrical accouterments, diesel additive tank, all gone. The area behind both sides of the rear doors are crumpled a bit, all doors and trunk still open. My poor, very expensive, amp took a hit.
Car ended up doing a 540 spin and ended up on the median.

Unibody is probably tweaked a bit. teh passenger door rubs now. The manager of the dealer said they would be removing the rear subframe and replacing the entire thing, at the very least. Both wheels were tagged, one from the minivan and one from the curb.

Damned women drivers! In a minivan, no less!! ::shakes fist::
 
Oh wow...that sucks... 🙁

You may want to have someone else look at it, too - if the passenger door isn't fitting anymore, the unibody is likely pretty well fucked.

cant see them not calling it totaled if the unibody is bad enough.

In situation like these, is it ever possible for the dealership to replace the vehicle?

Say the car never drives the same again and there's always little issues that they cant seem to fix. Is it still on their head at that point?
 
Repaired with BMW parts not to mention a check cut for the depreciation. Id be OK with the repair. Honestly though I would honestly try and get them to take the car as a trade (give you retail value) and give you a great deal on a replacement bmw.that's what I would hunt for.
 
Did the other driver stick around? If so it's going to be on their insurance, not the dealer. Yeah it sucks but it wasn't their fault.
 
Michigan is no fault, so the only thing I could get from the other driver is the deductible (not that I am paying anything 😛).

I have seriously been tossing around a european delivery, but I honestly love the 335d, I want what I have. God damn it. 🙁. The f30 has no soul compared to to an e90 335d.
 
I'm gonna have to say LOL if you believe their story.

Going straight...noticed they were about to get t-boned (protip: no one notices they're about to get t-boned)...so they accelerated and turned left (that car was turning towards whatever hit it)...

...either they're lying or your car was being driven by an invalid retard.

edit: good thing they documented it in full VGA, though.

Don't take the car back. Totalled or not is irrelevant. They'll fix the unibody if it's cheap enough relative to the cost of the car and try to give it back to you!
 
Omfg.... That is horrible..... Their story sounds like total BS to me. Have you seen this video? My bet is that it's not obtainable. Be SURE to get a copy of the police report.

As much as I love BMW, their dealers (in my area, at least) are beyond terrible. I've dealt with enough stupid crap to fill 3-4 threads at least. I would not at all be surprised if they were goofing off, as phuceneh said, you generally don't "see" a t-bone accident about to happen.


I would not even consider anything other than a replacement through insurance or BMW after an accident like that. If doors are sticking then replacing the subframe will not fix it.

I bet your insurance just totals the thing.

Yup... Agree... If they want to fix it and try to claim it will be good as new then tell them fine, 'buy' it from you and resell. These dealers are so incredibly shady with this crap.. Honestly, if it were me, I would already have a lawyer involved.

I've seen firsthand (either myself or close friends/associates) about 3 of these situations and none of them were dealt with in a professional manner.

This. Also, safety features such as crumple zones, or airbag sensors will never be the same. They are set with extremely high tolerances and bending the frame can affect that immensely.

Have your own insurance company come out to do an inspection. Don't go by the dealership's word.
 
I won't be able to get the report until Monday, I do not believe it's been completed yet. Looking online I see that it's filed but not yet available for purchase.

I have filed a claim with my insurance well to keep them informed.
 
I'm just guessing here but doesn't the dealer have a company insurance or something since they do test drives?
If so, they shouldn't be losing that much money on this, so maybe you can get them to exchange the car for another, in exchange of some money for the age difference or whatever.

Yep, add me to the chorus that says "get them to replace it". They effed up, they need to make it right. That means a NON wrecked vehicle of equal or greater value than your car was before it got fubared. Dealers are almost invariably staffed completely with aholes, so wade through the sea of excrement and don't stop pushing until your fist comes through their faceholes.
