Someone just backed into my car

I was at Blockbuster returning a movie. I decided to go in for a minute and look around, but left soon after because I didn't see anything I wanted.

I left at the same time as this other dude. He was parked in the spot infront of me--he had a bigass truck with a LCD TV in the back. I was taking my sweet ass time... pulling out my cell phone, putting windows down, changing music. I look up and see his reverse lights on, so I immediately lay on the horn. I didn't have time to take off the e-break and kick it into reverse, so he ended up backing strait into me.

He cracked the front of my bumper in several areas. The grill/lights/hood is all fine it seems... but I did see a cord dangling from the bumper... not sure what the deal was there.

He got out and apologized a bunch about what a total dick he was, haha. We were both cool about it. He said he would prefer just to give me cash after I get some quotes--I told him I was fine with that as long as the damage only involved my bumper, like it looked.

Maybe this is an opportunity to get an aftermarket bumper?
 
good luck if you didnt call the cops. my brother got hit by a local firefighter who said hed pay cash, so he didnt call the cops, and it was a *bitch* to get the guy to pay up.

You have to play this VERY carefully, otherwise you're going to get screwed big time.

If you were smart, you already have his personal information, DL#, and insurance information. If not, get it as soon as possible.

With that information in hand, turn it over to your insurance agent. Tell your insurance agent that the guy is interested in settling out of pocket. You can get an estimate (by yourself or through your insurance agent), and forward it to the guy.

If he pays out of pocket, great. If he doesn't, your insurance agent will file a claim against his insurance company.

If you try to handle this ON YOUR OWN, you will get the run around.

I was planning on handling it without either insurance company since I had all of his info, but maybe I will inform my insurance agent, like you mention.

Either way, I'm just happy that he *seems* to be upstanding.

His girlfriend was there too, who I think may have been in an accident or two--she acted very professionally, and made sure to fill out an entire piece of paper with all relevant information.

is that a state thing? every time ive heard of an accident in a business parking lot the police responded and allowed a report to be filed if it was requested, hell, it happened once to me in a mall parking lot when some old lady hit my car.

they do here. we got hit in a parking lot a few years ago. the cops showed up to file a report.

 
did you have your car checked out by a mechanic or someone who has a keen eye for how things should look under your car, especially the gears and transmission?

One of my friends got rear-ended when he still had his e-brake on and it screwed up his tranny.

I'm going to the dealership first thing tomorrow. They were already closed when this happened earlier this evening.

Yeah, those pics look much better than the others you have of it 'before' in your directory on atotchat.

I hope he doesn't screw you over and you can get your car taken care of soon.

wrong, they will, AND the shopping center probably has an existing agreement with the police to provide enforcement in the parking lot anyway. if anyone ever tried to pull that "i'd prefer to pay cash" crap on me, i'd be whipping out the cell phone.

for one thing, it is illegal to not report the accident if damage is over a certain very tiny monetary amount. that means YOU are committing a crime by letting this guy handle it under the table. and handling this kind of stuff is what you pay your insurance agent to do for you, so let him do his job.
 
If your car is anything like mine, that won't be cheap. I'm going through the same thing right now with my own car - same deal, girl backed into it while parked. Mine wasn't even as bad, the paint was just messed up - but the repair books give 6.5 labor hours alone to R & R the bumper. :Q The dealer estimate to fix it was $2300, and I also got two other estimates ($920 and $2700). I decided to be "nice" and allow her to pay out of pocket, and not involve insurance. I thought she'd be cool about it, since she told me that she hit my car in the first place, and offered to pay for it. Big mistake.

The place that gave me the estimate for $2700 on paper told me they'd do it for $1500 cash. This was the place I decided to take it, since the guy who would be doing the work had actually seen a car like mine before in their shop, and knew how everything went together - in fact, it turns out that the guy who came out and looked at my car for the estimate had looked into buying my exact car a month or so before I bought it! Turns out he had one before and a tree fell on it. He had wanted to get another since he liked it so much.

The other two places, including the BMW dealer (!), said things to the effect of "wow, we've never had one of these in here before" - not exactly very confidence inspiring. I don't want my car to be their shop guinea pig. So I gave her the 3 estimates, and told her where I wanted to take it - I felt it was fair, since it was the middle of the 3 estimates I got. She balks, then drags ass on giving me a check. She finally does, and it's for $923 - the estimate from the cheapest place, where I had specifically told her twice that I didn't want to take it. She says "Well I think this is fair, I'm a college student, I only get $xxx a month, I didn't know it would be so expensive....blah blah." :roll: basically making me look like the bad guy for taking this poor broke graduate student's money.

If I had it to do all over again, I'd insist on going through her insurance. Looks like I'll be at least a few hundred $$ - if not more - out of pocket on this one. Lesson learned.
