OK remember a thread about selling my brothers car??

There is a new twist regarding selling his car:

Yes I have his title, however the car's registration is currently expired (He never drives it), am I able to sell the car eventhough the registration is expired??

You're completely wrong. Legally the seller is responsible for smog.

sigh... i have to sell a car, too. What a hastle. I can't wait to get rid of it. Washing, insuring, registering, and maintaining two cars (when you only drive one) is a major pain in the arse.

Now I gotta call the DMV to see what the details are for selling a non-operational vehicle (fortunately no problem with my mother's car, I believe it was smogged with the last registration last month). 😛

If you take it to a dealer they will take care of all the details . . . however, you will get a LOT less money than by selling it to a private party.

If you take it to a dealer they will take care of all the details . . . however, you will get a LOT less money than by selling it to a private party.

will it be harder if a sell it to a private party if the registration is expired??

It depends. They may not believe you and may think there is a problem with the registration. If you are able - and the difference is worth your time - spend the bucks, register the car and smog it and sell it yourself.

If you want to "dump" it - head for several dealers but be prepared to be shocked. :Q

no, the seller must get it smogged. why? you can't even get the smog guys to do the job unless the car is already registered, and you can't get it registered to someone else unless it's smogged. a nice little vicious cycle i encountered when i was buying a car from some clueless old people. i can't even remember how i got it all sorted out, but i do remember it required multiple trips to the DMV and maybe even some posing as the original owner.

on another note, i got pulled over in that car about a month after i bought it. the problem was, i bought it for my girlfriend, and it was registered in her mother's name (cheaper insurance). gf was not in the car. not only that, i didn't have the new registration for some reason i can't remember. so i was driving a car registered to someone with no relation to me, and the only registration papers i had were for the previous owner, who also had no relation to me. i was getting all ready to head for jail for car theft but a miracle occured and the lady let me go with just a reminder that my tag was expired.

CANCEL the insurance the day it is sold (make sure there is no "penalty" for cancelling - some companies charge 10%). You ARE going to be driving it when you show it for sale.

You can pay the registration the car in Cali without insurance or smog - you just won't get the tags until you have proof of insurance or the smog completed - however, it gets the process started and avoids late-registration penalties . . .

Of course, its a PITA. . . . "work" usually is . . . it's your $$$. I'd call a few dealers to see what they will give - THEN check the local newspaper to see what private parties are getting for similar cars. Your right - SOMETIMES dealing with the Ca DMV is NOT worth the extra money you make. 😉

ok here is my current situation:

my brothers car's (whcih Im trying to sell) registration expired since last January, so late registration charge is a given.

MY POS brother is leaving the country (and not coming back), so I am "ordered" by my parents to sell the car (and also get the money, which is a nice thing)

I currently have the title for the car (under my brothers name), but the car's registration is expired, and there is no insurance on the car. In order to get the smog check, and also sell the car, Im thinking that I have to register the car first, then obtain insurance... however since the car is in his name, what should I do?? Can I add my name to the owners list of the car?? I dont want to transfer the car to my name, since the resale value will drop (2 owners of the car)

any suggestions in what should I do??

I'd transfer it to my name - since it is your brother, the State of Cali doesn't (never USED TO) charge except for the small transfer fee. A 2nd owner in the same family should make no difference to any (reasonable) buyer.

I think you probably can sell the car "as is" but then you probably have to certify it as "non-operational" first. ALL your questions can be answered by a simple visit to your friendly (and overcrowded) DMV (try Tues, Wed or Thurs - mid-morning for shortest lines). Work is never "easy" if you want to maximise your profits. If you want to "dump" it (at a big loss) - take it to a dealer. 😛
