Well.. I was recommended this kickass lawyer.. I contacted him yesterday at 3:30ish pm.. Got an email this morning:

"
I have talked to the attorneys twice already this morning?????..they want me to make a demand on Monday and they feel sure we can resolve this matter?.we?ll see??they have asked me to take the hearing off on the 7th as they are not available and the court would continue the matter anyway???so with your permission I?ll take it off for the 7th and make the demand on Monday. I do need accredit card from you for the fee today or arrangements for the retainer.

So.. everything sounds great so far... My court date was previously scheduled for the 7th.. sounds like they don't want to drive here from TN (the insurance hired some lawyer in TN..)

I had backed out of a parking space. She was backing down the parking aisle (A one way aisle) the wrong way. She backed into me. It was clearly her fault. Her insurance company was a no-name insure-all company. They made me jump through hoops, then denied my claim without basis except that (and I qoute) "If I had not gone to the mall that day, she could not have hit me, therefore it is a 50/50 fault claim (50% her fault 50% mine)

They kept telling me that they were going to pay, then not going to pay, and this has gone on since it happened. I finally got an awesome lawyer that does a lot of stuff for the company I work for, and they are wanting to go ahead and settle now (not go to court). He said that they did like 30 things wrong in their interrogation process and whatnot.. There is a meeting monday to decide how much they are willing to pay to not have to send a lawyer down here (I live in atlanta they are in tennessee) ....

you've gotta read some of the original thread. Some woman hit me.. clearly her fault, her shady insurance company denied my claim and wasn't gonna pay.. so I finally hired a lawyer who is kicking some ass so far

Well she was standing at the street corner, looking like this with a sign that said anything goes for 5 dollars. But se7enty7 was trying to bargain with her, so she got upset at the coupons and PM he was trying to do.

Dude that sux. I'm glad you're going after them though! Those shady insurance bastards probably pull this all the time and people just don't have the time or the money to hire a lawyer to go after them so they just drop the case. Good for you! Nail their a$$e$ to the wall! Sucks for the lady who hit you cause her rates are going up, but that's her fault.

I wonder where the crappy lawyers find jobs. I have yet to here anyone refer to their lawyer as anything, but teh bestest!@!@

Anyways...my ex wife supposedly had the 'best'....I didn't have a lawyer at all....I some how walked out with a better deal than I offered her, and within 1 month she was sued by a hospital I got her out of giving her whole settlement to by putting the money into a home. (Before anyone accuses me of ripping anyone off....her medical totalled $350,000 we recieved $100k (limits of policy) minus our lawyers fees, misc fees (which he did not tell us were separate), etc...we had about half that and the hospital wanted 100%. I called a few insurance companies I had friends in and offered the hospital what the ins. company would have paid...they did not accept that, so screw them...I don't believe in sliding fee scales in medical that hurt the individual).

At one point in time her insurance worker told me that:

"86% of teenagers who have their claims denied walk away. The 12% that fight us lose. You have a 2% chance of having your car paid for. "



There is $3000ish worth of damage to my car. It's really not about getting my car fixed, nor is it about the money. It's about getting these asshats to pay for what they are required to pay for.

I'm not 100% sure what the deal is. The lawyer is charging me $500 to deal with it all.

Right now my claim is at $4100. Damage is $3100, lost wages are $300, rental car for the time it's being fixed is $700. In all reality I'm going to end up with getting a ride to work anyway, so I'm still in the positive. That's assuming that the lawyer doesn't jack my claim up to $4600 as I hope he will. I'll email him monday morning and ask him to do that.

You don't make sense....why would the other insurance person tell you that and what the hell kind of math is that?

Then you talk about a great lawyer and only costing $500....I know my lawyer doesn't even get out of bed for that :).

Regardless of what he jacks it up to and what you can claim they are bound to want proof before paying anything out...if you are not using a rental car, they are not going to pay for one.

I don't see how it's $3100 in damages, plus it looks oddly like a sideswipe and not someone getting hit from the side while backing out of a parking space.

I sense shens or not the whole story being given.

one thing i am confused is why u are paying him in advance. I have been in couple of accident and everytime i didn't pay a dime to my lawyer till i actually got the check from the other insurance company.
