If this turns out to be true then there isn't anything stopping the GOP from getting a true Scalia replacement before the midterms.

No way will the Government appoint a replacement, they'll wait until the 2020 election so the 'People' can express their view, right? Or at least until after the midterms surely. Unless of course they weren't being honest with their reasoning last time. /s

I'm as shocked as anyone, but it appears that their arguments against Obama appointing a justice weren't genuine!
 
THIS* is exactly why I kept telling pissed-off Bernie supporters this wasn't the year for protest votes. The Dems can win back the Presidency and maybe Congress in a few years, but right-wing fanatical judges might be in there for decades.

*Well, that and climate change....and the fact that I felt Trump might start a war via twitter if he thought someone slighted him. First part is as bad as I feared, jury is still out on the latter.

I'll believe Kennedy is retiring when Kennedy says he's retiring. Same with RBG.

If that's what Heller is banking on to keep his seat then GOP donors would probably do well not to throw more money down the rathole.

This is one of those things I keep reminding conservatives of, not that they care. I remember when conservatives thought Clinton was going to win they had a backup plan of simply never filling the seat and shrinking the court to eight. Once you violate the norm that the president gets to pick who is on the supreme court there's no going back and the Democrats would be fools not to pull exactly the same thing.

This is terrible for our country and just leads to further dysfunction, but it was an easily forseeable consequence. Then again, conservatives putting party before country is not exactly new.

Even if the Democrats could overcome a highly unfavorable map this year I would hope they wouldn't stoop to the GOP level. Not because I don't think the GOP deserve it but because Democrats as a whole need to stop protecting the general population from the consequences of their own stupidity.

Rumor is coming from Dean Heller, who is the Senate's most endangered Republican.

Hillary won Nevada by 2.5 points in 2016. The Trump effect is swinging Republican states towards Democrats by an average of 27 points in 2017 special elections.

Heller is slated to lose his seat in November, and he has resorted to slinging mud at the wall to see what sticks and can excite his base.

Unfortunately for Heller, unlike other issues which are decidedly excite only the GOP base (like gun control), SCOTUS picks are equally exciting to Democrats (who are already at record levels of excitement).

If Kennedy announces his retirement, expect to see a new war cry for Democrats in their effort to regain the Senate. The House is already in the bag.

It's been here, but I disagree about it being "Republican" only judges. Roberts voted for ACA. He didn't like it, but he thought it was legal. Has a "Democrat" judge ever gone against their views on something so important? Serious question, I don't exactly follow soctus much.
