But he didn't know it was about to break. Do you really think that if the buyer asked if it was going to break Heller would have said "ya, you got me."?

If he knew it was about to break yet didn't mention it, that IMO is creating a misleading impression about the state of the 360.
I guess it just comes down to whether you believe in being honest, or are just interested in making a few bucks at someone's expense.
