I'm not super familiar with the process, having only filed like 2 claims in my life, but for both of the accidents I just reported it to my insurance company.

sent them the name of the other driver, their insurance information, and pictures of the accident... they did the heavy lifting and called me 2 weeks later once determination of fault had been finalized so that I could get reimbursed for my deductible (also had the option of not paying the deductible at all if I'd waited until after the determination to get the repairs)

That's what you're supposed to do. Why even call the other company? Call yours and let them duke it out.

Never filed an accident claim before so I honestly had no idea. Every claim I've done before has been from either getting stuff stolen or vandalism, so there was no other company to deal with. Geico (our insurance) said we had to file with their insurance. The entire thing has been a complete fuck up.

I was hit by an uninsured driver a few years ago and USAA took excellent care of me. They even waived my deductible so I didn't pay a penny for the repairs.

In some states it's law that the deductible is waived when an UD hits you or it's a hit and run, unfortunately FL is not one of those states. Adjuster did get back in touch with me and has offered to get me the $$ quickly. He said they were waiting for a police report but since it was a hit and run that has to go through the DMV in Tallahassee. Usually it's done in a day or 2 with the state involved it's a 10 day deal.

This isn't the industry. This is your crappy insurance. My insurance has never pulled crap like this.

I suggest you click the link in my OP, you might be surprised that even top-teired Ins. Co's are pulling this shit.

Take the time to call, adjusters will only tell you what is in their best interest and not necessarily the truth.

Normally copies of Police reports can be picked up at the filing agency within 2 days of the incident by you for any type of accident.

As far as OEM vs. 2nd tier replacement vs. used parts, unless the insurance statutes here in FL have changed in the last 3 yrs. or you signed paperwork agreeing otherwise, the choice is yours, not theirs.
Same applies to where you have it repaired, and they are required to pay for all agreed to damage. Keyword damage, not dollar amount.

They, of course, do not have to renew your policy and can raise your rates substantially after your claim, but that still doesn't mitigate your rights under the FL's insurance statutes.

We have a very strong and very pro-consumer insurance commission here in FL that many other states have used as their model.
It costs nothing to call, at least verify your being treated properly, eh?
