Roads here in TX are made for high heat, so anything under 70* makes them slick. Was going just under the speed limit but still could not keep the ABS off while trying to stop.

You're a dumbass. Always take the sideswipe over the t-bone no matter who is at fault. Nudge the center lane and everyone drives away with scratches, t-bone it's your airbags that go off and your own day is ruined.

it'll be an insurance claim nitemare if u avoided the stupid merc and sideswiped the suv in the other lane.
not as bad a nitemare if u didn't have dashcam but still a hassle.

the suv will go after u and u have to go after the merc.

but since the merc wasn't hit, s/he could have obvious to what happened and you'll never find her unless u have her plates.

tl;dr:
less hassle if u hit her instead of sideswiping the innocent suv in the next lane

I never liked the loop because there was a 1-2 second gap between clips, which made me worried since a lot can happen in 1-2 seconds. I only had at most a 30 min commute, so I just cleared that card every 3-4 drives.

I did a bit more digging and found that people had the same issue with time gaps. Though some have found changing the loop time can help get rid of the issue (can set to 3, 5, 10 mins), and also putting in a faster card. I'll play around with it to see if I can get better performance, but I mostly ride my bike these days and use a Sony Action Cam for that.
 
Nice save OP. Defensive driving is the only way to drive these days.

Regarding the dashcam, I just ordered one as well, don't know what took me so long.

wow that a dick. i really wish bad drivers didn't piss me off as much as they do, but i just see so much terrible driving around the DC area. i see that kind of shit daily for the most part.

OP - Regardless of what happened or any situation that is a 'what if' that has been brought up here... good on you for avoiding the fucking moron and making everyone's day a little less shitty. However, you could have used a little more horn letting them know what the hell they just did.
 
A tip for the future: Honk your horn as part of that maneuver. My wife used to work as an insurance claims adjuster. In many states (including TX, I believe), if you had hit her, you would have been considered partially at fault if you didn't brake, honk, and swerve to avoid the accident -- even in a case like this where it seems like it's 100% her fault.

Yup. If you don't honk, you didn't "do everything possible" to avoid the wreck, and are thus partly responsible (in the eyes of the insurance companies) in states that use comparative negligence.

Sounds ludicrous, I know, which is why I bring it up.

The opposite is the case on the east coast: maniac super-aggressive pill-heads and raging dickclowns rushing to get their chests blasted at Gold's Gym. Both are dangerous, but I honestly trust the raging chest-blasting bros more, because they are actually watching the road and do maintain general awareness.

The distracted, untrained, mostly immigrant crowd in CA are a greater terror, ime.
(and to preempt the rage: it isn't because they are immigrants, it is because the majority of them have immigrated from countries where: 1)cars and individual driving are a relatively new concept; 2) there are no existing road laws in these countries; 3) the general culture of the country, in public space, is to push your way to the front of a mass of disorganized humanity--no queuing, basically)
 
Actually... DrPizza brought up a damn good point, one that was a real gut check. If that Merc was slowing down because an autistic child was running out into the street I'm pretty sure any sense of self-importance would have evaporated the instant I hit them. In other words: It doesn't matter that in this situation I wasn't "at fault", it matters how poorly I handled it. If that car was slowing down for any other reason the outcome of the video could have been very grim.

A lot of things that are good for you don't taste very good, humble pie is one of them.

This actually happened to me - I was in a parking lot, not moving, waiting to make a right into a stall, and someone backed up into me.

I was ruled 20% at fault - said I should have reacted faster and honked.

Agree completely. In some accidents, the horn might have helped, but in this one, it clearly wouldn't. So this is a case where a dash cam could actually hurt things in terms of the insurance payout.

Huge props to you, OP. You've always got to be paying 100% attention because other drivers are idiots. If you come out to my neck of the woods, feel free to chat on the cell phone all day - on average, no cars within 1/2 a mile of you on the highway. But, with traffic around - it'd be nice if more people learned that lesson. And, thankfully, learned it without anyone getting injured or any property getting damaged.

Getting in an accident sucks even if it's not your fault.
I think I would have gone back for some discussion with that driver.
 
Good thing you avoided an unnecessary accident. They're definitely at fault, but do consider that you should've been at full alert as soon as you noticed the turn signal. Without being there, I'm guessing you could've slowed down entirely inside your lane and not hit them.
