Never doubt the determination of an 82-year-old man to change the world -- or at least the wording of his state's constitution.

Meet John Rolczynski: The Grand Forks, N.D., resident has been trying to tell his legislators that an error in the state's founding document means that technically, North Dakota is not a state.

Sounds like the ravings of a grumpy old man, but as it turns out, Rolczynski was right. News of uncertain statehood has put North Dakota in the spotlight and garnered big buzz.

Here's the story: Back in 1889, North Dakota was carved out of the Dakota Territory and admitted to the Union at the same time as South Dakota. Or so everyone thought.

But the state founders who drafted the constitution left out the key requirement that the governor and other top officials take an oath of office, putting the state constitution in conflict with the federal one. So Rolczynski has been arguing for the last 16 years that the omission made the state illegitimate.

Finally, somebody listened. State Senator Tim Mathern introduced a bill fixing the mistake that will be put to voters this spring. The happy historian, now confined to a nursing home with Parkinson's disease, told the local news team Valley News Live that he was "glad that I was able to see this thing corrected."

Not that he's finished with the founders: The eagle eye claims he's found another error in the constitution, this time having to do with the state's eastern border. Stay tuned.

Because of Constitution Error, North Dakota is Not a State (and Never Has Been)

A constitutional error recently discovered shows that North Dakota has never technically fit the requirements for statehood.

John Rolczynski, an 82-year old Grand Forks resident, discovered the error in 1995 and has been been campaigning to fix North Dakota's constitution ever since. The problem lies in the state constitution's omission in requiring the governor and other top officials to take an oath of office. In failing to require these oaths, North Dakota's constitution is at odds with federal requirements established by Article VI of the U.S. Constitution, therefore making statehood illegitimate. After nearly 16 years of fighting to change the constitution, Rolczynski may finally see his goal accomplished: Senator Tim Mathern of Fargo introduced a bill this spring that would fix the error.

According to Valley News Live, Rolczynski has found another mistake in North Dakota's constitution that he also intends to see corrected. This time, the error centers on which river defines the state's eastern border.

California is trying to make up the difference however...Once again, there is talk about splitting the state into two separate states...

Let me guess. Cali wants to split into 2 states. The northern portion would keep the California name and the southern portion would be known as "Newer Mexico"
 
The only reason there is a N and S Dakota is because the Republican Party of the time wanted more senators. It really should just be "Dakota."
 
Interesting. So, ND has a chance to get out of the shitstorm before the country is completely in ruins from politicians. I wonder if they will be smart enough to vote that they do not want to join.
 
The US is only 46 states then.

Florida is actually New Cuba
California is another planet
Texas is clearly their own country
 
They should tell the rest of the country to f off or they get the glass bowl treatment. Then join OPEC. Then Dickinson could replace Walmart with a Rolls Royce dealership.

I was going to complain to Comcast one time, but when I went to their page, they had a link to a web episode of some sort of Discovery-like show (not sure what the actual show was) on that exact topic. I was a bit intrigued, so I watched it. The show said that Ohio is a state, but for the longest time it technically wasn't. They already fixed the problem.
