So my ebay auctions were pulled off do to "Trademark Violations"

So I bought 4 sets Bose headphones for cheep that i was going to sell on ebay.
I listed them with the heading "Bose TriPort IE Headphones (In-Ear) **New/Unopened**". Everything was fine, were listed for about six hours then I get an email from ebay.

The email said "The rights owner, Bose Corporation, notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law."
Also "Trademark infringement is unlawful and violates eBay's policies. A trademark is a unique sign (such as a name, word, phrase, logo, or symbol) that a company uses to identify its products and/or services."

How is this even legal? Ebay is an open auction; you can sell what ever you want. Did they get pulled because I used the name "Bose"? I still don't even fully understand why they got removed.

WTF?

You were prolly selling them to cheap. So they had them removed. And dang those headphones are nice. I got a pair last week.

That is quite odd.

Seems like if they could pull your auction like that, they should be pulling ALL auctions b/c everyone's auctions "violate" some trademark/rule/law according to them.

If you had a quantity of more than one in the listing, BOSE may have determined that you are acting in the same manner as a dealer, and if you're not a "BOSE authorized" dealer, they are obliged to enforce their end of the exclusivity arrangement they have with AUTHORIZED dealers.

Just in case you were hotlinking to images from Bose's site, you might want to change that and host them yourself.

If you weren't doing that, just post the auctions again.

Just host your own images and stick a few TM signs in there, and you should be good.

Most companies don't care. BOSE probably cares because they think it hurts their image.

Where did you buy them for cheap? How was that possible, when bose keeps their eye on every authorized seller. Maybe they felt they were counterfit or stolen.

long story. but they are NOT counterfeit or stolen or fake or anything like that.

well i took a closeup pic of the box and then i said in the description.

Probably not BOSE per se, could be a Wholesaler or a Manufacturer's rep.
It could be a retailer, actually this is the most likely, imo. A BOSE retailer has to be dealing with some serious self esteem issues....I mean it's not like BOSE = B&O.

There are counterfeits of everything these days. From Rolex watches to flashlights. Yes flashlights. I have a Surefire U2 that cost $275.00. On ebay you can buy a knockoff that has a fake serial number and LOOKS very similar for ~ $25! Rest assured, like the Folex, there's a quality and functionality difference. But the fakes are there. I've even heard of fake shakelights (the ones that when shaken look like a man masturbating - ex - the fakes have lithium coin cells in them with a fake coil and iron slug instead of a neodymium magnet and 5F wet cap. So they are cheaper to make but appear the same. And guess what happens when the batteries in the knock off die? You can kill kittens all night long but you will still be in the dark. :laugh:

So as long as you have this behavior everyone is suspect. For the same reason you don't download and run exe's from anyone.

the starting bid was 10 cents
the same as the 100 other people selling them on ebay.

Have you tried emailing eBay and asking them exactly what was wrong with your auction according to Bose?

Oh yeah, good point. Come to think of it, if the OP got these things really cheaply then maybe they ARE fakes. Those shake lights suck ass. I got my mom one of those - I never thought I'd find a flashlight that's more useless than my Inova X1 until I bought that turd.
