So is Target just letting me keep both?!

We had ordered a piece of furniture for my daughter's bedroom for Christmas (was on her list)
Target delivered and she opened it on Christmas day.
On the 26th my daughter and I go an open the box to begin assembly, and realize "they sent the wrong one!"
I get on the phone with Target (India) and the man profusely apologizes and overnight ships the correct item.
Correct item was delivered on Wednesday and assembled Wednesday night.
... but I still have the WRONG item sitting in it's box in my garage.
I have no return shipping instructions (it's heavy and huge so I'm not dragging to UPS)
They don't have my CC on record so couldn't charge me for it (that I know of)
Do I just get to keep it or WTF? I want it out of my garage if not.

Q. Am I obligated to return or pay for merchandise I never ordered?
A. No. If you receive merchandise that you didn’t order, you have a legal right to keep it as a free gift.

Q. Must I notify the seller if I keep unordered merchandise without paying for it?
A. Although you have no legal obligation to notify the seller, you may write the seller and offer to return the merchandise, provided the seller pays for shipping and handling.

I think it's common for companies to write off mistakes; especially large companies.

But I did order something... they just shipped the wrong thing. That seems different than the way what you linked is worded.

You got what you ordered and paid for, but not in the time frame you expected. In addition to this, you got something you didn't order and can keep it. At least that is the way I look at it.

Honestly, unless it is an expensive item Target may look at it as more of a loss to take back and sell open-box than to let you keep it for free.

OP, yes you probably can get away with keeping it, but don't be a piece of shit. Contact them, see if they'll either send a return shipping label or let you return it to a store.

If they tell you to return it at your own expense, then I'd make a fuss and say no way its too heavy and too much of a hassle.

Maybe you'll get lucky and it'll be too much of a hassle for them and they'll tell you to keep it. That does happen sometimes, but I wouldn't just assume it, so unless they specifically tell you to keep it, contact them. Now if they don't respond (like if you sent a letter) or say they'll send you a shipping label and then don't, then I'd say ok as you did something to try to return it and its on them at that point.

Actually, how did you order it that they don't have your CC on file but shipped it to you? If they really wanted to (likely would not just because its too much of a hassle but some companies have done it over amounts that are ridiculously low), they could send you a bill and if you ignore that to collections since I'm assuming they have your name and address on file.

I'm pretty sure that applies to stuff that you were sent unsolicited (as in you did not order it). This used to be a huge scam, where companies would send you an item and then later on would bill you if you didn't send it back, even though you never ordered it in the first place. People thought it was free stuff (and some of the companies acted like it was, but it either had other stipulations like you had to order other stuff or something, or was said in fine print "return if you do not want to be billed") and would keep it not knowing what was actually happening. The FTC had to crack down on it.

I'm fairly sure this does not apply when they just send you the wrong or defective item. There is some gray area, but generally you are expected to return the incorrect item when you've received the correct one.

That's not really what that is though. A simple mistake if very different from receiving something you never ordered.

That's not even on the table, nobody is going to expect a customer to return a mistake at their own expense. The options are that they will tell the customer to keep the item or they'll send a pre-paid label to arrange a return. Almost certainly will be option a, it will cost more to return ship and then process the open-box item than it would be to write it off. Just don't be a dick about it, call CS and see. It's good karma and then you can keep it with a clear conscience.

How do they not have your CC? How did you pay for the original item? You can't return it to a Target store?

Does Target sell anything that costs over $100 that isn't electronics or sporting goods? That means whatever he bought probably cost less than $25 and if it is heavy it's probably not worth the hassle of going through the return process.

False. You can buy $500 in gift cards.

For what it's worth, here's an update. I did call, and they said due to the size/weight they would send somebody to pick up the package.
Well, the huge box has been sitting on my front porch for 2+ days now and nobody has come to pick it up. I REALLY love having that big box out there screaming "come steal me" for days on end.

Another day goes by and the box still sitting on my porch waiting to be picked up.
Not calling and sitting on hold again for their mistake(s). Over the course of 3 phone calls, we've spent easily 2 hours on hold/on the phone with them in regards to this.

If they're sending UPS to pick it up, it should be gone by now. If it's their own guy, who knows. I'd just keep it at this point and try to offload it somehow.

Good on your for doing that. And yes, at this point, if they want it back I'd tell them they need to make clear arrangements and follow through on them. Leaving it outside is an issue for you, as it is a clear opportunity for thieves, and furthermore, it would indicate no one is home so its like a big "hey, no one's here, come burlgarize the place" sign.

I'd keep it inside and if they want to get it they need to accommodate you, you've done more than enough to accommodate them.

Yeah but I'm not contacting them anymore -- I'm not wasting my time (and for that matter my phone minutes -- yes I have limited mins) again trying to get them their item back that they erroneously sent.
