well...not really but my 1yr lease expired...now month-month i guess...
and the landlord wants me to move by Apr 25....about 2mths from now.

he said he'll even give me $900 to move...i wonder if there's any law
in san francisco, CA...about things like this?...i REALLY DO NOT want to move...
not even with the $900 bonus money.

what do u guys think?...pls don't say 'hell yeah i will move for $900'...coz the money
is the least motivating factor here...🙁
 
Take the money and go. If he really wants to get you out of there, it's only a matter of time before he evicts you w/o offering the $900.
 
Since you are month to month, the landlord doesn't have to let you renew. He can essentially refuse to renew your April lease, thereby making you leave by March 31st. So, I would take the $900 and find a new place to live.

Well... it's his house, and your lease did expire, so I'm thinking the $900 + <close-to-2-month-notice> is pretty nice of him. Still sucks though.

The owner is probably going to sell the house, and the buyer don't want to deal with a tentant. Even with an expired lease, tenants do stay in the house/apartment and refuse to move, costing the owner quite a bit of money to get them evicted. The house's current owner probably wants a smooth sell, and 900 bucks isn't a lot considering how much a house goes for in the Bay Area market.

Chances are that the landlord:

a) Wants to remodel the place after slycat leaves
2) Feels like he/she could get a LOT more than slycat is currently paying
#) Wants to rent to someone else (i.e friend, family, etc.)

Fact is, that is a VERY generous gesture and not required by any sort of law. Landlord could kick slycat out on his ass come April 25 with no money whatsoever.

In CA, leases can not be broken without agreement by both parties, and a month-to-month rental is the equivalent of a 1 month lease. There is no guarantee that it can be renewed, so at the end of any "lease" period you can get evicted.
 
guys..the lease doesn't expire in April...it already expired...long time ago...
we never talked about it so i guess when ur lease expires it defaults to month-month?...i think...

anyways, reason he wants me out, and specifically by Apr25 is coz his children wants to move
in...their own lease ends end of Apr so he wants me out by Apr25 so they can move in...clean up..etc.

i said i ain't moving...he said...ok...i'll help u move with my truck..(he has a 4runner)..and i'll give u a
$900 incentive to move..

but i dun wanna move. yeah, its a house. 3 bedroom+garage.
i dunno about the 'my son wanna move in' story...sounds kinda pasty...
but is it true he can really, REALLY kick me out and not say anything?
there's not protection for renters in CA or something?....

I'd move before it gets nasty, he can get a lawyer and take you to court for trespassing if he tells you to move out.

you really dont have a choice in this matter, you are on a month to month lease unless you signed a new one. Take the offer or be stuck with the short end of the stick.

It's his house. It doesn't matter if his excuse about his kid is true or not. He wants you out, you're not under a contract. It sounds like he's being a nice guy offering you $900 and help moving. If you push your luck, you're just going to be out on your ass.

He owns the property, you're on a month to month lease. He gave you 2 months notice and even offered $900 to ease your way. How do you think this will work out in any way but you having to move?

It's not your house and you don't have any long term deal. He could tell you to be out by the end of the month if he really wanted to. You might be able to spend a bunch of money on a lawyer and turn the whole thing into a big pita but you'll still end up being evicted before the summer I'd guess. Start looking for a new place.

Depends on the old lease and state/county law. Have you read your old lease? Most of them have language in them about converting to a month to month agreement after they expire if both parties agree. Go read your old lease right now if you haven't already. Most likely all your answers are in there.
