Knock on the door tonight:
Man: "Are you XXXX XXXX?"
Me: "yes"
Man: <hands me papers> "You've been served."
Me: "what the hell is this?"
Man: <walks back to his car and leaves>

Apparently there was a lein on our house when we bought it. The contractor didn't pay one of his sub-contractors and owes them $5600 so they put a lein on the house...last November. We just bought the house 2 months ago.

For those of you that don't know anything about real estate a title company does a title search before you buy the house to check for these things, apparently ours sucked and missed it.

On a positive note, I have title insurance so I'm not on the hook for any $$ but I just know this is going to be a big pain in my ass.

Named in the lawsuit are the contractor, the realty company running the subdivision, me, my wife, and my mortgage company.

Sorry, had to say it. Contact the title company you used ASAP and bitch them to hell until someone other than you coughs up the $5600.

Sweet. Time to bitch on the phone to somebody until it gets fixed. Any chance you can just march into the title company demanding they fix it?

In person seems to get more results.........just don't read the crappy Walmart service thread.

I must say, that job has got to suck. For every polite person who just takes the papers, there have got to be ten people that completely blow up in your face and a few that probably threaten you physically. No wonder they just walk back to the car...it's surprising they don't run.

Does your title insurance company cover it? Not do you THINK it does....have you spoken to them and verified it? Because we just bought a house near campus for me and roomates to live in, and there were a few title insurance companies, one of which, if there was a problem, we would only be refunded the cost of the insurance, and not any claims :)

We set the record for the longest cash settlement in the area, 3.5 Hours, the house changed hands 10 times between 2 people in the past 5-6 years or so, and there was a piece of land that wasnt on the foreclosed title...oy what a mess, but you dont care about that :p

thats what i said lol

same thing with the home inspection...it was either $400 and they did a hefty throrough search, or $100 and if they missed something major they'd give you your money back :) the $400 covered a LOT more

Title insurance is a farce so I wouldn't count on it.

Lawyers sell it when it should be insurance agents. Parents bought a building that was to be inspected by the title insurance agent (their lawyer), he kept the money and didn't get the inspection done and low and behold the building is condemned (a strong wind enough to blow it over). Father is having impossible time claiming cause the agent has to do it--you can't go right to the company or something. Problem is that he can't find a lawyer who will go against their own. Lawyers are scum like that :(

I was about to say that too. WTF? That's 100% profit with no risk for that "insurance" company.

I could see maybe if they were a title investigating company... You pay them $100 to see if there are any title issues and that's all you get. If they fvck up you get your money back. That's not insurance though.
