So I hit a biker...

The person was riding on the sidewalk? In many jurisdictions, this is unlawful activity especially if the person is 18 y/o. If he was injured due to him illegally and operating a bicycle on the sidewalk and especially in an unsafe manner (darting out in front of a car), I can't see how you can be at fault.

The problem is collision with pedestrians tends to be at the fault of the driver of a car since a few thousand pounds of metal can be a deadly weapon and even if the person was doing something illegal like that you are still going to be under most of the blame because of that.

Pedestrians are not relieved of the responsibility of crossing streets in a safe manner; abruptly jumping in front of a moving vehicle is not considered safe.

So then what's this:

11.46.010 Areas of operation.

A. Except as otherwise provided in this chapter, gas motorized foot scooters may be operated on roadways, shoulders, and alleys, but not on sidewalks, bicycle lanes, or public paths.

Um, thats a law regarding gas motorized foot scooters... not a bike.

Here is the law:

Section 11.44.120 RIDING ON A SIDEWALK OR PUBLIC PATH. Every person operating a bicycle upon any sidewalk or public path shall operate the same in a careful and prudent manner and a rate of speed no greater than is reasonable and proper under the conditions existing at the point of operation, taking into account the amount and character of pedestrian traffic, grade and width of sidewalk or public path, and condition of surface, and shall obey all traffic control devices. Every person operating a bicycle upon a sidewalk or public path shall yield the right-of-way to any pedestrian thereon, and shall give an audible signal before overtaking and passing any pedestrian.

So yes, you CAN ride a bike on the sidewalk in Seattle.

Your story seemed pretty sincere. I mean you realize you were stupid for offering him $8 and for also going out of the blind alley too quickly.

The Bloods and Crypts are rivals so I doubt either one will go after you. LOL, so ridiculous.

Sounds like to me the guy is looking to milk this for some money. I will probably be called a racist for asking this, but was it a black guy? Sounds like it.

Ha! I was just reading the first post and I just automatically thought this biker must have been a black guy. For some reason, it was just too easy to imagine.

So I hit a biker today. Here's the story.

I was coming out of an alleyway so I had no vision of the sidewalk, and as I was creeping out at maybe 2 miles an hour, an 18 year old kid, seeing the nose of my car, decides to make a break for it without me knowing he's even there. I bump his left side with the front of my car at about 2 miles an hour, of course, he falls over, gets up IMMEDIATELY, walks over to the side and says nothing, I ask him are you ok? and he seemed fine, seeing as how he jumped p immediately, and he doesn't say a word. I pull out 8 bucks in cash, and since I saw in a hurry, I say "Hey, if you're not hurt and your bike looks perfectly fine, you can just take this money" NOW, he decides to speak up and say "8 dollars ain' enough bro". So I say ok... lets go somewhere and talk about this cuz theres a bunch of cars backed up behind me. again, no answer, i go into my car to pull over somewhere, he approaches me with a quickened pace and says "bra, you better not be goin nowhere, or the bloods and crips gonna get yo ass" to which i reply, im gonna park in the next street. So, the ambulance came to check out his "scraped leg" and he starts limping out of nowhere. I tell the police what happened, they file a police report, and we exchanged information, and that was it. Now, I'm all paranoid because this kid that may or may not have a gang affiliation has all my information: where i live and all that. but i have his. since he was biking on the sidewalk, does he have a case? what can he do? frickin idiot decides to outrun a car and then fakes being injured... aauggghh.. what a shitty incident

so you uninsured?????
I mwould pack my bags and move..send your wife to your mothers place until the heat calms down!! call the US Marshall`s office and get into a witness protection program......

Should have just yelled at him for hitting your car. I'm sure if you think about it you had actually stopped when he came shooting out in front of you clipping the front of your car as he passed causing him to fall and scrape his leg. 100% his fault. Thats the way I would remember it.

shoulda offered him tree fiddy.......thats gangsta.

dont sweat it. i hit 2 cyclists decades ago. they were going against traffic and i didnt see them. one threatened to sue me, the other wanted my car. lol neither happened.

did u have any witnesses around?

You're gonna be mostly at fault. It's legal to ride on a sidewalk in Seattle and he had the right of way. Maybe a really excellent lawyer could throw 10-20% at him, but if YOU hit HIM rather than him crashing into your fender, you're pretty screwed either way.

Did anyone write down that 8 dollars you offered him? If not, just deny you ever did it. The guy's faking an injury, it's not like he's gonna beat you in the Ethics Olympics. Your little 8 dollar bribe (which was retarded, by the way) almost sounds too ridiculous to be true, so if you just deny you ever said it, there shouldn't be a problem. Now if the cops wrote it down, then you're in a wee bit more trouble. You could still deny it was ever said though.

8 dollars. That's awesome. I like how your response to hitting someone is to rifle through your pockets and give them whatever you find. "Hey man, you OK? I got about 3 bucks in loose change, some Juicy Fruit and a chapstick that I only used twice. We cool?"

2mph is not creeping out. You go forward and stop and inch forward until you can see. WTF is wrong with you.

2mph is less than half walking speed for the average person. 7.5mph is slow enough to knock someone down with minimal injury.

that said, id have yelled at him for being an idiot and kept on going. i wonder how much clout he has to get the crips and bloods to work together in the mutual cause of avenging this dude getting knocked off his bike.

yeah i talked to my insurance claim guy and thats what he said, no matter how much of it was his fault, the court will at most make it 15% his fault because i was the one with the car, agh
