Your a douche bag for going to court ONCE and since you never got a letter you moved out of state thinking "oh well, they must have dropped the charges for no reason"

Of course not, and come on, your more then likely were or are still a user bro, you dont have people in your car with coke and hang out with people that do yayo and not do it socially or daily so stop being in denial. You also had to do something stupid in the first place to get pulled over so its really your fault that you and your boys got caught in the first place. They dont pull you over for no reason at all (despite what ppl like to claim). it was probably a crack pipe too, not a speed pipe and as countless others have already said, if it was in your car whether it was on someone else or not ITS YOUR RESPONSIBILITY in the eyes of the law. Yeah its not fair and etc etc but thats the facts and your pretty much ****** for runnin' on a narcotics felony charge. THey dont take that ****** lightly, and they will not believe your whole story as they wont believe that someone is that stupid (even if you are) to think that since they didnt get a letter everything was forgotten. I guarantee at least one person if not more will laugh at you if you use that defense. And I dont care what anyone claims, 99% of arrests are real, ****** the "it was planted" lame stories dude. Call the courthouse and find out whats going on ASAP. Every day you wait is another day in jail with bubba, just think of it that way man. And trust me, they will get your ass whether its weeks for now or months. Ive had way too many aquaintances think they can run from the court system and get caught eventually weeks, months or years later. The longer you wait, the more ****** up your situation will be man assuming this isnt shens.

Ok, with the disclaimer that I am not qualified to give legal advice (ye) and that this is only friendly conversation, you should probably consider the following (NOTE: I AM A LAW STUDENT, HENCE EVERYTHING BELOW MAY NOT BE 100% ACCURATE; RELY ON THIS AT YOUR OWN RISK)

1. Call "a" criminal defense lawyer and explain the situation...most lawyers are willing to give potential clients a few minutes of their time (off the clock), and if it turns out you can't pay, they should point be able to point you to an appropriate legal aid clinic or public defender.

2. Alternatively, if you can't afford a lawyer, call your local court house and ask for the number of the public defenders office. Do not give your name etc.... and do not explain why you are calling other then perhaps to indicate that you need to speak to a lawyer. Anything you say may be used against you if are are identified (assuming the phone call can be authenticated, even if you are not mirandized, because its a voluntary admission. Get the number, say thank you, and hang up.

3. Talk to your lawyer/public defender and explain the situation IN PERSON. Attorney Client privilege is easy to waive, and having a phone call with your lawyer when you are around someone else can destroy the privilege because you have no reasonable expectation of privacy. Arrange an appointment with the lawyer and discuss the situation in his office. Leave no details out when disucssing things with the lawyer. He/She is bound to maintain the confidentiality of what you say, and it is critical that they have all the info so that they can mount your defense.

4. Pray.... The law re: drug possession is notorioulsy strict....I'm not going to sugar coat stuff and say its likely your gonna get off scott free here. But whatever you do, maximize your chances to get the mercy or the court byu being as polite as possible, as well behaved as possible, and as courteous as possible. There is no sense pissing off the judge when he/she is considering whether to throw you in Jail.

5. Finally, be forthright. Portray yourself at all times as an honest individual. The longer you wit to confront this, the more it looks like you are hiding from it.

Also, here are a couple things about the law that may be of use to you:

1. If you are ordered to show up in court and you fail to do so, an automatic judgment isentered against you (I beleive this may only apply to civil cases, however).

2. The U.S. mail is presumed by the court to be reliable. This means that if party A mails something to party B via U.S. mail, it is assumed that party B received it.

3. I'm not certain, but I think in criminal cases you have to 1. be arrested; 2. go through grand jury proceedings (to determine if the government even has an iota of a case); and then 3. be tried in court. Unless you were arrested and booked before, I don't think your warrant could arise from failing to show up in court, although judges can issue arrest warrants for the purposes of obtaining witnesses for trial. Did one of your friends in the car get arrested and go to court for this? Maybe your friend or one of the attorney's during that trial wanted to call you as a key witness? Just reaching at anything here.

Oh!!!! ONe more thing that I learned just recently in my evidence class. Your lawyer will probably know this, but you should attack the hell out of the 'chain of custody" for whatever the cop took out of your car. Things like drugs are easily tampered with, so cops have to be very very carefuly to ensure that the location and identity of any narcotics evidence is carefully documented. If there is some time period where the location and status of the drug paraphenalia is unaccounted for, hammer on that and argue like crazy that the authenticity of the drug paraphanalia cannot be authenticated under Federal Rule of Evidence 901. If the government can't introduce the drugs, then they have no case.

Again, follown the above at your opwn risk.

Reminds me of last summer...nursing school had us run a background check on ourselves, print it out and return it to the nursing school(kinda retarded since anyone with decent computer skills could forge it). So anyways I run my name under the state registry and blammo it gets a hit on my name(damn common last names) Guy has the same first name and last name as me and ironically was born in the same year as me.

However I'm not worried since at the top it says the state search only uses first and last name and NOT unique identifiers(such as SSN or drivers license). And it even says this guy is serving time for his crime,(grand theft auto, grand larceny, breaking and entering etc etc) So I send this copy off to the nursing school thinking it wouldnt be a problem.....til they told me they were removing from the program for having a criminal record!!!! Needless to say we had the run around from the nursing school and the state, my name still shows up on the state list since the state takes forever to fix problems, but the nursing school relented when I was able to run a federal search on my name and nothing came up :p

Hey thanks for taking the time to help me with my problem.
Im now thinking of flying back to cali to confront this problem.
Yes, my friend did get arrested for the same charge, he had the same judge i had for a different offense. Thank You Agian guys.

Heh, this reminds me of a buddy of mine.
He has a DUI + a warrent for his arrest in Washignton. He lives in California now. He has been pulled over in California, but they never took him in or anything

You watch too much TV. Only time evidence tampering is an issue is if it is obvious. Attacking it in court will only get you laughed at. I bet you think most investigations and court cases are over in 30 minutes too?

Yes. He does. He was stopped by the cops apparently (in the OPs car with the OP driving), and him and his friend were searched. They found narcotics on his friend.

He apparently never properly handled the situation.

NOPE, It was in my car, we were parked, they searched my friend, found yeyo on him, nothing on me.then after talking to each other for a minute(2 COPS), he searched my car and said he found something, i asked him if i can look, he said no, then i asked him to show it to me. he didnt and he didnt put anything on the hood of my car.
SO i have reason the belive that he planted the drugs,, or is using the same drugs my freind was found guilty of and tried to get me for it.

ALSO!! AT THE STATION HE SHOWED ME A COIN PURSE WITH A SPEED PIPE, AND SAID HE FOUND IT NEXT TO MY CAR. HELLO, THIS COP IS OBVIOSLY BULLSHITING.

You're pretty screwed. Generally law enforcement and the court systems don't really appreciate when you get arrested for drug possesion and then skip town. Good luck explaining that one.

OK, I'll tell the professor of my Federal Rules of Evidence class, who, as it turns out, is a FEDERAL JUDGE, that you think he watches too much tv. I'm sure he will take your opinion into consideration. And if you think attacking the chain of evidence in a drug case will get you laughed at in court you are, quite simply, an idiot. Moreover, I have never once seen anyone get laughed at in court (and no, Judge Judy is not "court")

As for your other statement, I won't say anything except to say that its funny how people who know absolutely nothing about the law find that they are in a position to criticize those that actually do know something about the law.
