So I got a M.I.P.

I'm 16 years old. I live in a middle of nowhere Missouri town. There isn't much to do other than get drunk. So I did at a huge party a couple nights ago. My friend was DD and he had 1 beer. There were 5 of us in the car in total. A long line of cars were leaving the party and we were driving fine but we ended up being the ones that got pulled over. The cops said we had a tail light out. At the time we didn't know but we just said ok. Long story short, the driver is given sobriety tests, passes 3 out of 4 but then we're all given breathalyzer tests. The driver blew a .021 (we would've been off if he had blown below .020..) and the rest of us blew .022, .08, .07, and a .151 for me. Then we're all cuffed, taken to jail, and then our parents came and picked us up.

Now I don't want to hear about how what I did was bad, or about how I had what was coming to me. I'm just wondering if it's possible to get our M.I.P's reversed because as it turns out the cops lied about the tail light. It's not out (nor was it).

Also, are all 5 of us going to have to get lawyers, or if just one or two of us do and we get off on the tail light thing, will we all get off?

That sucks mang. Only time I got arrested was when someone called in a bullshit report on us... not the same as your case, but shitty nonetheless. Pay the fine, etc, no worries.

you might, but you'll have to pay some $$$ to get a good lawyer

it'll only be on your juvenile record, unless you have your own large $$$ , are you parents going to be willing to spend large $$ on a lawyer?

i would chalk it up to experience, it isn't like you have to live will killing someone by drunk driving or something

You knew what you did was wrong but did it anyway.
Take responsibility and accept your fate .

And no, you can't get out of it.
The bulb could have been loose.
Its just a routine stop.
If the light really was out and no one was drinking your friend would have just gotten a warning ticket.

I threw in what we blew on the breathalyzer. I don't know how that may affect my chances..

It doesn't.
If you blew anything at all you were under the influence, under age.

How do I know all this ?
Sister is an attorney 🙂

I hear her talk about stuff like this all the time.

Its not a major deal and not going to be on your permanent record.

Cops can lie about you, threaten you, beat the shit out of you - whatever they want and there's nothing you can do. Why? Because at the end of the day its your word vs. that of the cop.

Be humble and accept your punishment and with any luck they won't try to pin anything else on you. And don't get pulled over next time.

How much is the fine? I took some class to get the charges dropped from my record, the state had a diversion program. You could try to prove the cop circumvented the law but good luck proving it. It's probably less hassle to just pay the fine.

I'm not sure. I know my dad didn't have to pay anything at the jail but past that I don't know.

Here's the rub: you're legally not allowed to record what the cop said. How fucked up is that?

Wrong, the legal limit for minors in Missouri and many other states is .02%.

That's not true...

I know (paranoid) people who have cameras mounted in their car just to record encounters with police.

You're a tool. Take the punishment.

Why is he a tool? 😕
Who the hell didn't have a beer or go to a party when they were 16?

Well I didn't, but I'm probably just a dork 😛

And maybe tool is a strong word, but he decided to drink underage, got caught, and is now trying to get out of it, which seems kind of wrong to me.

That being said, I do give him and his friends a lot of credit for having a designated driver.

I accept any punishment I receive. That doesn't mean I'm not going to try to get out of it if that's a possibility.
