So I get rear ended today (With Cliffs)

God Fvcking Dammit I hate Miami more and more!!

Driving home after a long ass day of work and some dump biatch rear ends me as a result of simply not paying attention, I even noticed her swerving between lanes just a few moments before the accident, she was following me so close I couldn't even see her in my rear view mirrors either.


So she hits me, we both get out and I ask if she's OK, she says yes, I look at the damage and her car seems fine but my bumper is a little fvcked up, so I ask her for her insurance info, she hands over her card, I write down all the info plus get her phone number and license plate number, mind you this all took place while in the middle lane of I-95 around the "Golden Glades" area of Miami, anyone who's ever been through this area knows its some of the worst traffic around.

So I said I have to check with my office to see what needs to be done and that I'm going to get out of the road and pull over.

She follows behind me for a little while I'm trying to find an opening to get over to the emergency lane and after a mile or so and able to do so and she keeps going.

I didn't sweat it to much anyways since I had all her info and we both were OK.

I call my H.R. lady since I was in my work van and ask what needs to be done, she tells me that its required by our insurance for the company to file a police report, so I call the Florida Highway Patrol and them come to me on the side of the road and I give them all the info and tell them what happened and they ask me why I let her go, I said I didn't but she may have thought we were all done and it was taken care of since I had already gotten her info, the FHP guy calls her number and she answers and said we "made an agreement to not contact the police" then tell him that "she's going to take me to court"

The FHP guy give me my report which I need for insurance reasons and says he's going to go to her place to give her a ticket for rear ending me and leaving the scene.

Now I really don't give two shytes if this girl were to get a ticket or now and to be honest I'd be perfectly fine with our insurance companies working it out, but since its a company insurance this isn't an option, and since she is going to get a ticket she now threatens to take me to court for rear ending me and leaving the scene?!?! :confused:


Cliff notes:

Dumb biatch rear ends me
I get all her info
I pull off the road
She doesn't
She threatens to take me to court since she's getting a ticket for hitting me.

WTF?

As a added bonus I now get to take a pee test first thing tomorrow morning.

And No, I'm not worried even if she does try and take it to court, she was totally at fault.

You obviously didn't leave the scene, you got all her insurance information and waited for the police.

exactly so why are you so angry? It was an inconvenience for sure. But a) she rear-ended you and b) she left the scene. both of which automatically make it entirely her fault. she can take u to court till kingdom come and it'll always be her fault hands down.

I'm angry because I got rear ended.

I'm angry because it took 2.5 hours from the time I called FHP to the time I was done and able to continue my drive home.

I'm angry because she threatens to take me to court with no just cause.

I'm angry because I can't get this damn softmod working on my friends Xbox!!! rawr!!

Why are you upset? Shes getting two tickets. I got rear ended in a work truck (when i lived in melbourne beach FL of all places) and i had to take a pee test. No worries, you get paid to go to the doc for a bit.

on top of having nothing to worry about, it wasn't even your own car. This should do nothing to add to your stress level.

i dont know if it was fair that she is gonna get charged with leaving the scene... she stopped, traded info and left. it is not like she hit you and ran. neither of you mentioned calling the police or making a report or anything. She probably just figured that once you traded info it was a finished for the day event.

First, it's not your fault so there's nothing to worry about. Even if you left the scene, since it wasn't your fault you don't have much to worry about.

Also, you make it look like she's a pretty nice girl in the beginning of your story.

Dude... you're forgetting about your *neck* - the sharp, shooting *pain* in your neck ;) If you're going to the doc anyways, might as well sue her, your employer, the FHP, etc.

because even tho it wasnt OP fault, he has to waste his time to go to court, get his car fix, file insurance.

i'm sure he has better things to do then to deal with this non sense
