So a guy enters an intersection and blocks the other flow of traffic...

So a guy1 enters an intersection and blocks the other flow of traffic. Guy2 gets mad as he loses his green light due to guy1. Guy2 gives guy1 the middle finger.
Cop sees all this and of course writes a ticket for the idiot that blocked traffic right... right...

Man cited for "flipping the bird" at another driver

Even the police will not go on camera to defend this. That and the ACLU has already said they will jump in if asked.
And cops wonder why the public is turning on them more and more.

Me I probably have to control my laughter then flip the cop off and call him a jackass on top of that just to see if he would double down on the tickets.

Here in Colorado, that is Harassment.

Harassment - (18-9-111)

A person commits harassment if, with intent to harass, annoy, or alarm another person, he or she:
(a) Strikes, shoves, kicks, or otherwise touches a person or subjects him to physical contact; or
(b) In a public place directs obscene language or makes an obscene gesture to or at another person; or
(c) Follows a person in or about a public place; or
(d) Repealed.
(e) Initiates communication with a person, anonymously or otherwise by telephone, computer, computer network, or computer system in a manner intended to harass or threaten bodily injury or property damage, or makes any comment, request, suggestion, or proposal by telephone, computer, computer network, or computer system that is obscene; or
(f) Makes a telephone call or causes a telephone to ring repeatedly, whether or not a conversation ensues, with no purpose of legitimate conversation; or
(g) Makes repeated communications at inconvenient hours that invade the privacy of another and interfere in the use and enjoyment of another's home or private residence or other private property; or
(h) Repeatedly insults, taunts, challenges, or makes communications in offensively coarse language to, another in a manner likely to provoke a violent or disorderly response.
(1.5) As used in this section, unless the context otherwise requires, "obscene" means a patently offensive description of ultimate sexual acts or solicitation to commit ultimate sexual acts, whether or not said ultimate sexual acts are normal or perverted, actual or simulated, including masturbation, cunnilingus, fellatio, anilingus, or excretory functions.

It's a misdemeanor, but.. still a law.

It's a law but it's a law that isn't enforced, like many laws, and for more or less good reasons.

The other day I was in two lane traffic on the right. Light went green. I went. The person to my left didn't. Know why? She realized all of a sudden she wanted to take a RIGHT at those lights despite being in the left lane so she screwed over all the traffic while she figured things out instead of turning around later. It's stuff like that that drives me crazy.

How is that law not against free speech?

Same as shouting fire in a crowded movie theater is not free speech. Unless the theater is really on fire. So you can only flip people the bird if they are actually copulating in public. 😱:sneaky:😀:hmm::awe::hmm😀:

Damn, I do this all the time. Good thing a cop has never seen me I guess.

Idiot drivers need to know they're being idiot drivers.

I swear I saw a thread about this and a SCOTUS decision saying it was protected free speech.

May be on this list I just found...

EDIT
Make some money doing it...

1990: When a patrol helicopter hovers 800 feet over a home in Oceanside, California, the owner grabs a flashlight, aims it at the chopper and flips off the officers. Minutes later, a dozen officers converge on the home, hogtie him and arrest him and his wife. The prosecutor refuses to press charges against the couple, who later win $300,000 in damages.

1998: A jury awards a junkyard owner in Arkansas $4000 in damages against a state trooper who arrested him for flipping the bird as they passed on a county road. Earlier that year, the man's nephew had received a $2500 settlement after being arrested for flipping off a different cop.

2009: A federal judge ruled that police had violated David Hackbart's First Amendment rights when he was cited for flipping the bird at a Pittsburgh police officer. In April 2006, Hackbart was attempting to parallel park when another driver blocked him. He flipped the driver off, then heard a voice say, "Don't flip that driver off!" It was a passing police officer, so Hackbart flipped him off too. The officer cited him for disorderly conduct and for violating a state law prohibiting the use of obscene language and gestures. The ACLU got involved. The city said the citation was given in retaliation by the officer, not for "blocking traffic," as the city contended. The city eventually settled with Hackbart for $50,000.

You guys on the same softball team or something?

I bet it has more to do with an obscenity ruling rather than free speech.

Peace

Lounatik

If "obscenity" was illegal and not protected by free speech, then those WBC nut-jobs wouldn't be able to hold signs in public saying "GOD HATES FAGS." Or at least, one would think.

Move to NJ - The middle finger is pretty much what we use to say "Hi".

...and the cop could/would have ticketed guy #1 for blocking the intersection in the first place.

Once that's accomplished: Move back out.
