Actually, I understand what you are saying completely. Do I agree with government telling private business owners what to do, and how to do it? Not at all, as long as the private business owners aren't doing anything illegal. If you want to get around the law, here you go:
A few establishments are exempt from the law, including private clubs with liquor permits as of May 1 and tobacco bars.
Smokers can go to private clubs, and/or tobacco bars, if they really need to smoke that badly. Private business owners can open PRIVATE clubs. Who says they need to make their establishment public?

This is a bastardization of terms here and another sign of our eroding freedoms. ALL businesses not owned by the government are, by definition, PRIVATE businesses. What your law means is member's only clubs.

At any rate, I ask again, why do you blame smokers instead of bar owners? Don't you think if bar owners respected your views they would have banned smoking themselves? If they do not respect your views, why do you want to do business with them? Not only do business, but do business by force?

Well, when Howard Stern's number comes up, and I am certain that it will, I will link to this thread to remind everyone that "Just change the station or turn off the radio" is apparently as silly as "Just go to another bar or don't go to the bar at all." You either support a nanny state, or you don't, and it's easy enough to see which side of the fence everyone is on.

The connection between ETS and cancer is highly questionable. And the minority of studies that claim a link involve people who live with heavy smokers. Not people who have infreqent contact.

And besides that, no one is forcing you to enter a business that allows smoking. You do that by choice. Again, you do NOT have a constitutional right to force businesses to accomidate you.

It has nothing at all to do with cancer, and free speech doesn't include certain forms of speech including defamation, obscenity and "fighting words," of which any schoolmarm can easily accuse Stern, and not meritlessly, either. I only chose Stern because I know from past readings that you are one of his sycophantic fans and it would be a good litmus test on whether you are consistent or not when it comes to eroding away of freedoms.

The bottom line is this: You don't care about personal freedoms as long as it isn't your personal freedom that's being eroded. That goes for anyone who agrees with this kind of legislature.

To the whiners who can't handle Howard Stern: TURN OFF THE RADIO.
To the whiners who can't handle smoke: GO TO A DIFFERENT BAR.

The more you rely on the government to take care of these basic things that you as an intelligent adult should be able to handle on your own, the bigger the government will get, and soon enough, they'll handle everything whether you like it or not.

Today smoking, tomorrow Caesar Salad. Oh wait, California already tried that one back in 1998. Luckily they came to their senses.....for now. But let me guess - you'd be OK with that, because you don't like Caesar Salad.
