why exactly are you going to the dealer? Im a bit confused as to their liability or what you hope to get from them.
 
Where is the semi's insurance in this equation?

Maybe I'm wrong, but how is the body shop liable? They did not damage it, the semi did. Also check the papers you signed, there might be waivers of liability when you hand over the keys.

Although I'm curious what corporate will do. Dealerships have lots of power and I've never gotten anywhere with any dealership at the corp level.

to be blunt, i'm out to get anything i can. i bend over backwards to buy the car and keep it perfect, and now it's forever spoiled, with $10k left to pay. the trucking co. wants to pay cash, but i'm getting their insurance involved - a) pay for the repairs b) rental car c) if i'm getting forked, there will be an official record of it. but, the value of the car is lessened. assuming the repairs are ok, when i go to sell the car years from now, any buyer is going to look underneath and see the car has been chopped and stitched back together. i wouldn't pay full price for that, would you? is the insurance going to cut me a check for that? no.

i'm mad as hell, and i'm not going to take it any more.

edit: i think the dealership has already dicked with me on the warranty. the car moved (causing the original damage) because the handbrake failed to hold it on a very slight grade. the dealership found no problem, and won't cover any of the resulting damage.

I see, well I hate to tell you I think you're in a "tough luck" situation, but i understand your pain, so instead good luck and I hope things work out.

Seeing as you already went to the dealer, although you don't have much to stand on, if you can maybe prove mechanical failure due to the emergency break, you can look into your State's lemon laws and perhaps start from there.

Don?t forget to tell them you want some sort of compensation for deprecation. This will shop up on car fax and hurt the value.

When I was shopping for a A4 cabriolet (for sister in-law) I found some that were nice but they had minor, like parking lot scarp and repaint bumper minor, damage report on carfax and my sis-inlaw said no without even seeing the car. My wife is the same way. That and when you do go to sell people will offer you less and I bet even say ?well car fax says it had body damage??.

Have you reported the 2nd accident to your insurance? I would call them up and see what they say and maybe get some free advice.

Hope all goes well with you, I used to work at a Ford Dealership that had good people all around, they would have treated you better I hope. Here's hoping everything pans out for you.
 
sucks that it got hit while at the body shop, but I still don't get how a parked car can slip out of gear? and have the handbrake fail at the same time?

That sounds reasonable. I hope they don't raise your rates, insurance companies are so damned evil.

Is the damage worse than just body panels? $5k is astronomical for just two fenders, a hood, and a grille, with paint. But of course, much of the price you hear about for body work is due to the shops charging insurance companies out the ass in order to make a hefty profit. Buying aftermarket body parts can look sweet and save $$, check the posts below, including the Skyline grille, Carbon Fibre Hood (light!), and guaranteed OEM-flush fenders, even a Nismo front bumper. Put them all on yourself, then get it painted professionally, and you've got a sweet custom look.

Stay away from aftermarket fenders, the fit and finish is horrible. You're much better off going to a junkyard and picking one off a car (especially if you can find the same color). Also never EVER buy any fiberglass bumpers.

i got a call from the shop today. an 18-wheeler backed into my car and did this.. the left rear quarter of the car has to be chopped off and a new quarter welded on. value of the damage: shop mgr said $4000, in reality at least $8000.

will this car ever be "right" again? the value of the damage doesn't reach 80% of the vehicle, so it won't be totalled. even if it was, i can't replace it with the check i'd get.

Jesus christ, your car just took 20% hit on the resale value. ABSOLUTELY HAVE IT TOTALED. Pick it up, drive to the best body shop and have the damage estimated, by law the insurance companies can't force you to bring more than one estimate.

On a side note, anyone that knows anything about cars will be able to spot weld-on unibody parts. No matter how good the body shop is, since the part is already on the vehicle, they will leave lines from where the mask off the other parts. Plus all the creases (where the qp meets the roof) are virtually unreachable so you will have overspray and/or orange peel in em.

i'm not in the ghetto, i'm in a nice suburb. the cinder blocks were a gift from the ghetto dwellers that stole my wheels.

yeah, that's the exact spot the car rolled from. the police found no evidence of breaking into the car.
