It seems the school has a very broad definition of sexual harassment:

Superintendent Dr. Robin Gooldy said under the district's sexual harassment policy, the fourth definition fits both circumstances, which reads, "Unwelcome touching, such as patting, pinching or repeated brushing against another's body.

Overall the 'misconduct' seems far more appropriate and its good to see Hunter's mother agrees:

I believe school should be a place for learning and not for children with problems behaving badly over and over and over again but hey it is just me.

A 6 year old shouldn't even be suspended, just call the parents.

Pro-tip: little kids, especially boys, are by nature active and tend to get in trouble and fights. Most of the guys on this forum have gotten in plenty of trouble as kids. Your solution is what? Send them all to Gitmo?

Read the section that I posted about how this boy had been in trouble many times before and been suspended several times. He did not learn his lesson and did his bad deeds again.
