Should these tenants be evicted?

Hey ATOT, the tenants in one of my properties didn't pay their rent... uh oh. I'll give you their sob story/excuses and let you decide!

Their story: The wife had her car stolen, rather than pay rent the husband claims he leased another car for her. Things are 'tough' and he promises to pay the Friday of next week.

Rent was due for $849 on the first of this month. Evictions aren't fun and I'm a pretty forgiving guy in real life. When I reminded the husband of the terms of his lease he got coy ("I ain't payin' no late fees!"). Normally I would work with a tenant who had a valid real life concern but his attitude really bothers me.

He was late the month prior when a member in his family died and I let him slide without hitting him with the late fee's. I get the feeling he thinks I'm a softie college student because I let him off the hook once.

So, should I trust my gut and evict these tenants?
Or, should I show compassion and work with them?

You decide! 🙂

Update: Filed for eviction. Court date is set for 8:30am May 12th.
 
if he already played the "dead relative" card AND the "stolen car" card, then his time is up. evict NOW!

Eviction is a slow process. Start it NOW. It'll probably be September at the earliest before he gets the notice to vacate the property.

i was going to say cut some slack until i read that. he can EaD.

if you do let them pay next week then you sure as hell better collect on the late fees.

late two consecutive months is being a prick, i'd hit 'em with the charges.


Eviciting people is rather diffult i thought - you're gonna have to wait and give 'em notice and stuff.

that's what i'd do.

i think it would be common courtesy that if you can't pay your rent on time, you make alternate arrangements with management.
 
Based on the info provided, I can't make the call. Sounds like you are ready to be as accomodating as landlordly possible before you give them the boot, and for that you get a :beer:.

Business is business. Can't slap him for late fees retroactively tho.
 
It takes so long to evict I would start the process right away. You can't get rid of them right now even if you want too. What will happen is that they will pay you the back rent right before court and you wont be able to boot them. Then they won't even pay the very next month. That starts the whole process again. Sometimes they don't even pay and you are just out after waiting six months to get to court. Six months and no rent. IT takes a civil suite to get the money back. You'll probablly loose too.
