While it was probably an honest mistake. When you post an auction you get to look over it before you post it. Its not your fault they cant read their own listing.

How about a netural rating. That way you get to put in what he did and allows other to make sure they don;t get caught up in it.

in his auction, it said this

Auction Terms

Payment MUST be received within 7 days of auctions end.
By bidding you are entering into a legally binding contract.
Non-paying bidders will be reported and Negative feedback will be given.

sounds like i should make him eat his own words by giving him a neg

People still make mistakes.
So if I mistakenly threw a puppy off a cliff you're saying there should be no consequences?

i would also tend for the negative, especially in light of his phrase "By bidding you are entering into a legally binding contract". You operated by his rules in good faith that you would receive the item, only to have him change his mind based on his mistake. Sorry but he should have been more careful, and shouldn't expect someone else to help cover his lapse in thinking.

sure... he should pay attention to details.... besides, you can't get hit with a neg. feedback anymore....

I can't? Is this some kind of new policy?

I was just thinking as I read your thread..."you can't", lol. Stupid ebay policies...I believe its just the seller can no longer leave negs. They also made it where any feedback older than 12 months, doesn't count on your percentage anymore.

EDIT: just realized that you're the buyer, not the seller...oops. Still can't leave neg though? As I said...stupid ebay.

It's a contract.

....meaning, it's up to you whether or not you want to give him a break.

Find out what he'd sell it for...if that's fair then you still profit...

If he starts going on about he decided not to sell or the item is lost/damaged.

Neg, he sold it to someone for more outside ebay.

Personally I would leave him a Neg.

If the tables were turned and you were the one that backed out of the deal, he would be pissed. He specifically put that buy it now price and entered himself into a contract stating he would sell it for that price. You bought it, and entered yourself into the contract that he stated at the bottom of the auction.

Nicer people wouldn't leave him a neg, but I would rather leave it as to let others know he might drop out of an auction and not sell you the item.

Its better to let others know that this seller could possibly drop out of the contract than to leave him a positive feedback and nobody knows what happened to you.
