How do we determine if someone was distracted? Does reading a billboard count? What about it a passenger tells a funny joke and you laugh hard for a few seconds? What about when a cop puts his lights and siren on behind you - does this count as a distraction?

I'm thinking more along the lines of the people that can't maintain a lane, slam into other cars or drive 20 under the limit because they are on their cell phones.
 
Very difficult to prove. Alcohol/intoxicants stay in your system after you get pulled over and can be proved. Adjusting the radio, talking to the people in the back seat, eating, etc are much easier to cover up when the bubble gun machine starts rolling.
 
It's been shown in studies that talking to passengers is far less dangerous than talking on the cell phone (even if it's a headset and both hands are on the wheel) due to the fact that the passengers act as a second set of eyes.

Really they should just ban cell phone use via implanted device unless the car is in park.

With how low the intoxication levels are, texting while driving is probably worse than being .08% BAC and driving.
 
I get really tired during my daily commute sometimes..

Sleepy driving is 1000x worse than drunk driving IMO. I pull over to the shoulder sometimes because of this =(

Innocent until proven guilty. Beyond all reasonable doubt. Etc, etc.

The reason DUI enforcement has been so strict is thats something they can actually prove.
 
No, you cannot prove that someone was distracted. Besides, you can pay attention after being distracted momentarily. You cannot become un-drunk though.
 
I do not think driving while drunk should carry any penalty. Crashing while driving is another story. If no one is hurt, no one is hurt. Penanlizing for potential is beyond fucked.

Based upon that, it's ok for someone to walk into a school with a submachine gun, and as long as they don't shoot at anybody it's ok?

yeah. texting/cell phone is way way worse than DUI.

...unless your shit-face zombie drunk, of course. but ~0.1% is a freaking joke.
