Judge Jack W. Smith delivered a 'shocking' ruling today dismissing yet another ethics claim against Sarah Palin.

The judge said Wednesday that there is no provision in Alaska state law that prohibits the use of private e-mail accounts when conducting state business.

he case stemmed from a lawsuit filed by Anchorage resident Andree McLeod who is responsible for the majority of the ethics claims against Ms. Palin. So far, ALL of the ethics claims have been dismissed.

Yea doing things on a private computer system and not allowing it to be open is great. :roll:

I am sure if Obama, or another Dem, did this you rightwing-trolls would have a field day.

She might be not guilty under the law, but using a personal e-mail account for government business is still shady.

Huh, Obama is a FEDERAL employee and has cannot use a private computer system for government business BY LAW.

I'm pretty sure Alaska law clearly states that using a private email address for gov't business subjects you to review by a death panel.

Palin ethics probe finds abuse of power, Palin hitting back hard

An independent investigator for the Alaska state personnel board found probable cause that Alaska Gov. Sarah Palin abused the power of her office by ?securing unwarranted benefits and receiving improper gifts through the Alaska Fund Trust", according to The Associated Press.

Thus far during her tenure as governor, there have been twenty ethical complaints filed against Palin, seventeen occurring after nomination as vice president, and three of which are still pending decisions. This is the first complaint that has been decided against her.

If law = right all the time, this would be fine. She shouldn't have been using a private account to begin with, whether it's illegal or not.
It was posted by a mod to shame that person ... apparently.

Palin's lawyer, Thomas Van Flein, said that the findings of the investigation were "released in violation of law. There has been no Board finding of an ethics violation and there is a detailed legal process to follow before there is a final resolution."

The newspaper statement that there was a final resolution is just plain wrong, there is more consideration yet to come. And the whole issue stems from whether Palin can have a legal defense fund, the investigator thinks she should have the State of Alaska pay.

I think she should have a legal defense fund AND have the State of Alaska pay for her defense when these politically based accusations keep falling like a deck of cards. The State should then seek recovery from the accusers.

Accusations are not convictions.

Palin was unceasingly the subject of partisan attacks and spurious ethics complaints to minimize her effectiveness in office and on the campaign trail.

Put these claims in the "Dirty Tricks and Dirty Politics" circular file.

Yes they are. Saw another one a few weeks back. I think there was a discussion in PFI, but can't remember exactly. Just recall that it was interesting the persons name, address and phone number was publicly posted. Not saying good, bad or indifferent, just commenting.

U.S. Sen. Lisa Murkowski on Tuesday told an Anchorage crowd that critics of health care reform, the summer's hottest political topic, aren't helping the debate by throwing out highly charged assertions not based in fact.

"It does us no good to incite fear in people by saying that there's these end-of-life provisions, these death panels," Murkowski, a Republican, said. "Quite honestly, I'm so offended at that terminology because it absolutely isn't (in the bill). There is no reason to gin up fear in the American public by saying things that are not included in the bill."

Well, if some of you people will do some thinking, a superior Court Judge is not all that high up on the judicial pecking order, and far from
the last word on the subject. As is the plaintiff in the case said, "McLeod's attorney, Don Mitchell, said it was too early to say if he would appeal."

As for any Palin resultant image renewal, it might be fair to say she has won some and lost some, but for the fact she keeps offending by being a serial distorter of the truth. Her latest trick is somehow conjuring up the idea of Obama death panels out of almost thin air.

I state with some confidence, that the vast majority of the American people still regard Sarah Palin as an grade A certified nutcase. And as time goes on, ole Sarah will keep proving it. I have every confidence in Sarah Palin in that regard, even with the decenting opinions of our OP, Dick Cheney, and Rush Limbaugh duly noted.

I remember a time when I was accusing BBOND of being BOBDN (shocker), and I was told I would be banned if I didn't stop. Guess we have a new unwritten rule I missed, both times around, granted that was pre-forum reformation :)

A puely situational assessment waggy. If State law prohibit clearly the use of private email accounts being used by public officials to conduct state business it may be one thing, but I might argue that if a state official uses a private email account to conduct purely private business, things like honey, can you bring home a gallon of milk on your way back from work, that exception should be allowed.

But since it can't be told in advance in States with such laws, it becomes a slippery slope.
