It could have probably been avoided if the gas station admitted to their mistake and said to not worry about it.
I understand what you're saying, but she was right, and so I think that if the gas station didn't sue her for the mistake, she wouldn't have had counter sued for damages to her vehicle and mental stress.
I don't remember exact numbers, but in incidents like the Mcdonald's coffee case, the coffee was shown to be *very* hot, beyond what it should be. It caused burns to her that she had to be hospitalized for, which came to $10k or something, but they refused to pay. It kept escalating and became much more eventually. I blame the corporation, not the consumer.
