If the woman says didn't give verbal consent, and the man says she did, isn't the burden of proof still on the state to prove she didn't say yes? The jury is supposed to be convinced "beyond a reasonable doubt", so if it's a matter of his word against hers, and she doesn't have bruising or the fellows skin under her fingernails, don't they have to acquit?

It's hard to believe that they actually came up with something this stupid. What's even worse is that we paid these idiots to do it.

So every once in a while you get something stupid like this from liberals, but you have a never ended stream of rape talk from conservatives.... therefore totally equal.

I think the "yes means yes" part essentially means nothing. Consent has always been required. The only weird part to me is the inability to consent while drunk.

Forcibly or unknowingly drugged (by any drug, including alcohol), fine. But IMO you are responsible for your consent if you willingly and knowingly take the drugs yourself. Just like you're responsible for any other behavior after deliberately drugging yourself.

By this law, it is the opposite. The accused guy would have to prove that she indeed said yes. Otherwise he is a rapist

It is not about whether she said no or resisted. It is about whether she said yes. Otherwise, rape

So, Cali is running out of water, and the legislators are worrying more about sex. Sounds about right. On a side note, there won't be a lot of sex if no one can shower. And bathing in saltwater and then having sex is not recommended.

It takes a short video of each partner giving verbal and visual consent (think Vine), allows each to enter an email address, and accepts signature/thumb print of each participant, draws up a short one-line consent contract and emails it to both parties with video, signature, and thumb print. Trojan will also mail you free condoms as a cross-promotional offer.

This is how it’s supposed to go: You sign up for the app with your name and phone number, find a partner and — when you have decided you want to do the deed — open the app and hand her your phone, which asks if she’s down. The person you want to sleep with will have the opportunity to choose from three options: No, Thanks, Yes, but … we need to talk, and I’m Good2Go.

If your partner does indeed choose the third option, then a new set of questions will pop up, asking her to rank her level of sobriety. (For this article, we assume that in most cases, men will be asking women for their consent.) The choices range from Sober to Pretty Wasted. And if she chooses the latter, the app warns that she “cannot consent,” denying permission for the whole act.

CNN contributor Roxanne Jones, who say she advises her sons to “never have sex with a girl unless she’s sent you a text that proves the sexual relationship is consensual beforehand.”

Can't give consent or held responsible for having sex if drunk but still held responsible if you are behind the wheel drunk and run someone over or get pulled over by the police.

Yeah, well as many of us know, the self professed 'smartest guys in the room' are often far from it. Humoring them is getting to be really expensive and one day we're going to have to cut them off cold turkey.

"Consent" apps and texts are useless when consent can be revoked at any point (including retroactively?). Emma Sulkowicz, the Columbia University student who is carrying a mattress around with her 24/7 until the school expels her alleged rapist, has stated that her rape started as consensual sex. From an interview of her:

One night there was a party for the orientation leaders. In the ivy-covered courtyard outside Wien Hall, Paul kissed Sulkowicz, who says that she was sober except for a sip of gin-and-Sprite. He was buzzed and carrying a handle of vodka. While they were having consensual sex in her dorm room, she alleges that he suddenly pushed her legs against her chest, choked her, slapped her, and anally penetrated her as she struggled and clearly repeated “No.”

Maybe what we need is for both partners to have to hold a 'thumb's up' sign during the entire sexual act to clearly demonstrate both that consent has been granted and is still being granted. Anytime the thumb comes down, all sex must cease immediately.

The bill met no Republican opposition in the state Senate, but Assembly Republicans "questioned whether statewide legislation is an appropriate venue to define sexual consent between two people," according to the AP.

Yeah those Republicans are so good at protecting our rights, not.

If they had opposed the bill, there would certainly be a slew of "war on women" attacks against the GOP. Damned if you do, damned if you don't.

This is California setting the bar on insanity even higher.

That place is incredibly fucked up, they're just lucky they have great weather and natural resources or the entire state would be a wasteland.

Hmm, so a new employment opportunity has presented itself - sex monitors. See, they're really geniuses in CA. Will the couple be able to choose the gender of the monitor? Oh wait, of course not, that would be discriminatory...

Wow ... lots of conservatives in here angry at how much harder it will be to defend the actions of rapists. Can't say I'm exactly surprised considering they tend to defend every single rapist in every single P&N thread as it is.

Are you really so stupid that you can't see the unintended consequences of this law??? Really???? That's what people are upset about. I doubt seriously that ANYONE one here wants to defend rapists, but you had to go there. Typical brain-dead behavior.

I really do struggle with the whole issue of making pot legal. I see the definite advantages of decriminalizing it and move towards making it legal. Then I see stuff like this and wonder if all that pot smoking really does cause brain damage, which pushes me back the other way on the issue.

Yes I thought that was a very pertinent paragraph in that piece. Like many things with wisdom, not quite in line with the political correctness of our age.

The society does not seem to understand that there is an animal inside each man, all of us males. That laws alone cannot prevent sexual crimes. Yes males have been tamed for the most part, but that wild animal is still there inside somewhere. For some it is deep hidden, for others, not so much. It is part of our biology.

Yes males have been tamed for the most part, but that wild animal is still there inside somewhere. For some it is deep hidden, for others, not so much. It is part of our biology.

But we've passed laws against bad things, and created programs! How can these bad things still exist?!?

The problem is, whoever accuses the other of rape is presumed to be telling the truth. This law upturns innocence until proven guilty. This country is going down the drain.

I will say this, the truth is, sex is a barbarous act and it does not always constitute goods this. Nor are the participants always good. Men will sometimes use force which they should be punished for. Women will often seek out wickedness in men.

Poor poor men. They used to sit in the cat bird seat but now it's occupied by kittens. But the feminized men will be OK. The men of the future will be kind and gentle, delicate and squishy, and of course, liberal. Instead of Sunday football, we'll sit around and knit. I will teach you how to do Ikebana.. Women DESPISE feminized men. The whole reason countries like Japan have such low fertility is because the females of the human race do not want to mate with feminized men - men who are not aggressive and confident. Mark my words, world wide depopulation (except in africa) due to gender relations and various other social issues being messed up will be one of the defining problems of the mid 21st century.

Don't you get it moonbeam? Let me say it explicitly - women find evil attractive and sexy.
