Senators Challenge Pres. Obama on Rumors of Executive Order Amnesty

Monday, June 21, 2010, 4:58 PM EDT - posted on Nu

"Several Senators have learned of a possible plan by the Obama Administration that would provide a mass Amnesty for the nation's 11-18 million illegal aliens. Led by Sen. Chuck Grassley (R-Iowa), eight Senators addressed a letter to the President asking for answers to questions about a plan that would allow DHS Secretary Janet Napolitano to provide an amnesty if they can't secure enough votes for a bill in the Senate.

The letter that was sent to Pres. Obama earlier today asks the President for clarification on the use of deferred action or parole for illegal aliens. The executive actions are typically used in special cases and are evaluated on a case-by-case basis, but if 60 votes can't be secured in the Senate to pass a mass Amnesty, the Administration may use the discretionary actions as an alternative.

Here is the text of the letter signed by Sens. Grassley, Hatch (R-Utah), Vitter (R-La.), Bunning (R-Ky.), Chambliss (R-Ga.), Isakson (R-Ga.), Inhofe (R-Okla.), and Cochran (R-Miss.).

Dear President Obama:

We understand that there’s a push for your Administration to develop a plan to unilaterally extend either deferred action or parole to millions of illegal aliens in the United States. We understand that the Administration may include aliens who have willfully overstayed their visas or filed for benefits knowing that they will not be eligible for a status for years to come. We understand that deferred action and parole are discretionary actions reserved for individual cases that present unusual, emergent or humanitarian circumstances. Deferred action and parole were not intended to be used to confer a status or offer protection to large groups of illegal aliens, even if the agency claims that they look at each case on a “case-by-case” basis.

While we agree our immigration laws need to be fixed, we are deeply concerned about the potential expansion of deferred action or parole for a large illegal alien population. While deferred action and parole are Executive Branch authorities, they should not be used to circumvent Congress’ constitutional authority to legislate immigration policy, particularly as it relates to the illegal population in the United States.

The Administration would be wise to abandon any plans for deferred action or parole for the illegal population. Such a move would further erode the American public’s confidence in the federal government and its commitment to securing the borders and enforcing the laws already on the books.

We would appreciate receiving a commitment that the Administration has no plans to use either authority to change the current position of a large group of illegal aliens already in the United States, and ask that you respond to us about this matter as soon as possible."

Don't forget this bit from last Feb (NY Times):

"Obama Making Plans to Use Executive Power WASHINGTON - With much of his legislative agenda stalled in Congress, President Obama and his team are preparing an array of actions using his executive power to advance energy, environmental, fiscal and other domestic policy priorities.

WASHINGTON - With much of his legislative agenda stalled in Congress, President Obama and his team are preparing an array of actions using his executive power to advance energy, environmental, fiscal and other domestic policy priorities.

Mr. Obama has not given up hope of progress on Capitol Hill, aides said, and has scheduled a session with Republican leaders on health care later this month. But in the aftermath of a special election in Massachusetts that cost Democrats unilateral control of the Senate, the White House is getting ready to act on its own in the face of partisan gridlock heading into the midterm campaign.

“We are reviewing a list of presidential executive orders and directives to get the job done across a front of issues,” said Rahm Emanuel, the White House chief of staff."

Whipping up the rightwing fear & outrage machine for the election, I see...

Y'all should run down to the basement, fondle the duct tape and plastic sheeting stashed in 2002, count your ammo, play some tapes of Rush, Hannity, and the rest, rave mightily on the internet...

I'll assume you dont live in a town infested with illegals. If you did, you would not think the issue to be fairy's and unicorns. And his campaign in 2008 should have convinced you he's very much interested in handing our country over to invaders.

With, Graham getting upset over his loss in the Climate Change bill and under fire from his own party for being too liberal I'm not surprised it's led to this.

That's the travesty.

Fail government is fail.

Yup. Reagan was a crazy, scary fucker, and he couldnt get rid of them. Obama is a bleeding heart pussy and while I dont think he's straight up Anti-american, I will say he has some weird ideas about whats best for America. Add to that he wants the hispanic vote for himself and his ultra-lib congressmen, you can pretty much figure on it happening.

Amnesty is inevitable.

It's not reality to think Obama can wave his magic wand and give illegals amnesty in a failing economy and people are just going to be chill with it. No doubt Obama would want an uproar so he can have an excuse for more power. We have a presidency failing in a major way with an indoctrinated radical who is prepared to turn everything upside down. Bad days ahead no doubt.

So is death, however I doubt you would lie down for it.

Nevertheless, we've heard rumors before. If Obama were to be so foolish to do it, you'd have a complete reversal of Democratic fortune. Not only would the Presidency lost to someone as inept as Palin, but I believe that there would be an excellent chance of the Republicans virtually eliminating Dems from both Houses.

I doubt the Dems or Obama really want to poke that bear.

I wouldn't put it past him. He keeps going against the will of the people as if he has some magic trump card. Agree there would be war in our country if he did so.

While I would oppose the measure in substance, this could be the catalyst that the USA needs for a collective epiphany regarding the unchecked growth of executive power.

If Obama wants to make a sweeping executive order to push Congress towards better policy he could pardon all the people convicted for non violent drug offenses instead. That would get a mass cheer from the lefties and the true libertarian types who are hiding in the GOP and tea party demographic. It would be nice to fracture the tea party for good, because it's a rather motley crew ideologically speaking. Not enough true liberty minded folk for my tastes.

Something needs to be done. What we are currently doing isn't working at all. Not that its the best idea but at least its got people debating what to do....

But who is going to challenge those Senators on rumors of them being secret Satan worshippers? Someone needs to look into these rumors.

Anything he dose in mass like that would end poorly, it make him look more like he is trying to control more and more sidestepping all legal means of action.

Ahh, if I were only so confident. Look at the thread regarding the decision of a judge to override Obama's shutting down oil wells. I recall some of these people being upset when 43 broke the rules IMO, however when THEIR guy gets called on it, suddenly it's about expediency and the law be hanged.

Somewhere I learned that those who exceed their Constitutional mandate need to be reigned in regardless of party or "good intentions". It's virtually guaranteed that someone down the road will do the same but not for a cause the apologist would approve.

Ironically I see this as already happened. I'm not sure Obama wouldn't be more restrained if the last guy hadn't pushed it.

We either get a grip on this now or it expands with every new administration.

The saddest thing in American politics is that the partisan public refuses to hold their own to the same standard the require of the opposition.

I have a strong suspicion that once control passes back to the Reps, they will have learned nothing, then the Dems in their turn.

And so it goes...
