Kennedy is the reason they don't have that provision. He successfully lobbied to have it removed in 2004 so the Republican Governor would not be able to replace Kerry had he won.
They basically want to keep changing the rules depending upon who is playing. Its cheating no matter how you slice it but, as has already been mentioned, most people here are perfectly fine with cheating (depending on whose side your on and who is doing the cheating of course).
