Senate extends Internet Tax moratorium

WASHINGTON (AP) ? The Senate on Thursday night approved a seven-year extension of a moratorium on state and local taxes on Internet access.

The Senate voice vote came a little over a week after the House passed a bill calling for a four-year moratorium. The tax ban, first approved in 1998, is set to expire Nov. 1.

Attempts in both the House and Senate to make the ban permanent in recent weeks were unsuccessful despite strong support for the idea.

Sens. Tom Carper, D-Del., and Lamar Alexander, R-Tenn., in a joint statement called the agreement "a commonsense victory both for Internet users and for state and local governments."

The two chambers will have to reach a compromise on the length of the ban and other differences before the bill can be sent to the White House for President Bush's signature.

Does this ban prohibit sales taxes being collected or something else because it's clear that internet commerce is eroding local sales tax revenues and most people do not claim them.

 
I like this as well, but what concerns me the most is why this is a Federal issue. Sales tax has always been a state issue and should be kept in the hands of the States.

The internet isn not the wheel. If some company can sue Amazon for infringing on the 'one click' ordering button the internet certainly was patentable.
And since it was developed with US tax dollars we should not just give it to the world for free.

The internet isn not the wheel. If some company can sue Amazon for infringing on the 'one click' ordering button the internet certainly was patentable.
And since it was developed with US tax dollars we should not just give it to the world for free.

Patents that could relate to the creation of the internet would probably have terminated by now. I'm guessing that you can charge them to have access to our Internet or they could create their own separate one. Not sure how that stuff works.

Yeah, the patent would have expired by now. But think of the trillions of dollars the US could have made.
And think of the lower taxes, greater public works, etc.

And think of the lower taxes, greater public works, etc.

I doubt it would be what it is today if the US charged others for it. International development brought things to the Internet as well (like WWW).

It falls under the Federal Govt because of the very loose interpertation of the Interstate Commerce Clause.

I don't see how that changes.

The problem as I see it is how do states collect sales tax from out-of-state retailers who lack sufficient nexus as defined by the SCOTUS. The states can't enforce such e-tailers to withhold and remit, they lack jurisdiction.

I suppose I should actually read the damn link. But I do know taht the states have been getting together and lobbying for federal help on the matter.

Some states were already taxing before the original law was signed and they were grandfathered in I believe.
