semi-repost for clarification:why isn't being a porn star considered illegal?

Prostitution is seen as illegal, yet these porn stars on film do essentially the same thing... they get paid to have sex, yet I don't hear of any porn stars being put into jail. What's the deal with that? Preferential treatment? So just because they charge more and look better, its seen as legal?

Please clarify, cause I don't understand the logic.

Thank you

porn stars get paid to act. The sex is free and "incidental" to their performance. Hookers are paid to slob your knob. No acting unless they fake enjoying it. Then THAT'S free.

That seems to be the general idea behind it. Same reason why you can hire an "escort" and pay for her company for the evening, if it just so happens that she is so turn on by you that she wants to have sex with you, well at that point it is just two adults having sex. It's all in the details

is that the technical reason? cause couldn't you say the same with prositutes? just tell the girl beforehand that this is an "act"... would that be legal then?

I'm still in the gray

This has been hashed and rehashed over and over and over.

The porn industry is all regulated, everyone is an employee, there is testing, forms to fill out, etc, etc, etc. The government gets taxes + permit/license money.

With prostitution there is no way to control it...in Nevada with the Brothels there, these also undergo regulation and all the girls/staff are regulated. They don't allow for streetwalkers there.

Prostitution could be a legal entity, it's just that no one wants to stand behind the cause....plus the 'devout' carry a powerful lobby against it.

yeah, if you made being a porn star illegal, then what would happen to actors and actresses that actually have intercourse on film? They're getting paid mainly to act, but they have sex as well. A porn star could make the same argument.

"I'm an actress, it just so happens my film is all about sex."

hehehe... I agree with you, IMO I think cops in general should not arrest prositutes because the two are not well defined. Yet, we still see this going on in shows like COPS...

If the issue is taxes then you can't arrest the person until next April because they haven't commited tax evasion yet.

For awhile the porn industry was prosecuted for everything from indecency to prostitution. The Supreme Court rule it to be unconstitional to try to censor or inhibit it.
