Selling Gifted Microsoft Software - Legalities/Information

Saga

Banned
One of my co-workers obtained free copies of Microsoft SQLServer 2005 and Visual Studio 2005 through a promotion at another job. He's now dead set on attempting to sell these software packages through e-bay. I am honestly not familiar enough with the legalities of these software packages when given away freely, and I would presume that they are probably copies labled "Not for Resale".

Taking into consideration my limited understanding on promotional software and legalities involved with selling them, could someone please point me either to a document that would be helpful to use in convincing him to NOT sell these via e-bay, or even better yet a small written explanation as to why he should not with facts that I could just relay to him on behalf of the poster?

Or, if I am simply uneducated and my google search abilities have failed me, and he can legally sell these pieces of software without any repercussions, please feel free to tell me how much of a fool I am before I make a comment to him as to why he should not.

Thank you.

Continuing my never-ending search for understanding,
Izu

he won't get in trouble, ebay doesn't care what you do as long as they get $ from the deal

but "Not for Resale" seems pretty obvious

http://news.morningstar.com/news/PR/M12/D15/1134655862559.html?pgid=qtqnPress5

against people for allegedly selling not-for-resale software to unsuspecting purchasers.

The individuals named in the MAPS lawsuits are Catherine Will and Philip Parana, Buffalo, N.Y.; James Baker, San Diego; Kenneth Ham, College Station, Texas; Benjamin Hesson, Leesburg, Va.; Charles Klosek, Glenn Dale, Md.; Jimmy Huh, Encinitas, Calif.; Eric Mitchell, Santa Ana, Calif.; and Lang Ngo, San Francisco.

so have him call these people listed and see what advice they offer

The document you're looking for would be the license agreement that came with the software I think.

I think Microsoft routinely scans eBay auctions and makes them pull any auctions for NFR software. And if he doesn't label it as NFR in his ad, I would think the buyer would be ticked.

or the sticker on the package that blatantly says, "Not for Resale".
