Selling alcohol when one person is underage

I'm still really confused by this supposed law. I'm 23, but if I attempt to buy alcohol and someone is with me (even in the store with me), who is 20, they won't sell it to me. It's kind of a no-brainer why they won't, but at the same time, it's confusing. I mean, does the law say you can't sell to someone if they have a minor with them? Well, that can't be, cause clearly they'll sell wine/beer/liquor to a mother who has her child in the store with her. So is just a law that says "at your discretion," or what?

not sure about the law, theyre covering their ass.

leave the underage kids in the car, should be pretty easy to figure out.

Yeah, it's not a difficult problem to solve, but in this particular case I didn't even think about it, because we actually had innocent intentions, ha! The guy with me wasn't planning on having what i was buying. In fact, neither was I (it was a gift for a friend who covered something for me at work). The other guy with me was actually doing his grocery shopping, as was I, and I picked up some booze amongs the rest of my food. They (the store) were not down with that.

before i was 21 i went into the store plenty of times with friends when we bought alcohol. hell, one time, i paid for it with my CC when i wasn't 21 and the clerk didn't care.

Next time don't buy alcohol with a minor in your party. Problem solved. That's your common sense tip of the day.

Its completely random. I've gone in plenty of times with friends back when I was underage and the clerks didn't card either of us. The only time a clerk ever said anything to me when I was under 21 was that I couldn't carry the alcohol out of the premises (we had a large order!). If you have someone under age with you just tell them to wait in the car and put the booze in your trunk when you leave, problem solved!

And why the fuck can't you buy hard alcohol in supermarkets in many states in this country? I don't get that...:confused:

Costco has a very nice selection of hard alcohol here and a very nice selection of very good wines too. I can buy a 1.75l bottle of Skyy vodka for $19.95 or a 1.75l bottle of Grey Goose for $49.95.

Hell, Walmart here sells Skyy vodka...but they are actually quite overpriced on that.

Store policy.

Same reason 7-11 around here has signs up that says "We will card anyone under age 55"

law says they can't sell to someone under age 21...

law doesn't say they have to sell to everyone over age 21.

Ding ding ding! There really (as far as the store is concerned) is a difference between the parent/child case you mentioned and the 2 friends situation. Parent/child is immediate family; what you buy them to drink is your choice. 2 friends on the other hand, that's "supplying intoxicants to a minor" (whether or not you actually partake).

I have been denied purchase at grocery stores and at liquor stores because there was a minor present or one of my friends (who was over 21) didn't have their ID. It's not that hard to tell them to get lost when you are at the register or have them wait in the car.

The law is stupid but it's easy to circumnavigate.

For cigarettes here you aren't allowed to sell cigarettes to someone if you suspect they are buying for someone else underage. Doesn't mater if they actually are or not, it's up to the clerk. If person A doesn't have ID but person B with them does and offers to step in and buy the cigs you can't sell it to person B even though they have ID.

This is what I always didn't get when I worked retail. Every day we would get no end of shit from customers angry that they couldn't buy cigs because we IDed their friend with them and their friend didn't have ID. Well shit son it doesn't exactly take a rocket scientist to ask your friend to stay outside while you come in does it!?!

A mother and her child are and your situation are two different things!
A mother is NOT buying alcohol to take home and give to her child.
You on the other hand with a friend are a completely different story!
Even if the intent is to buy as a gift!

What I don't get is how people who are of age don't have ID with them when they go to a store. It's not that difficult. It's not something that you have to think of when you go. It's your driver's license. You keep it in your wallet.

Yeah, that is pretty stupid. I can understand people occasionally forgetting their wallet but why would they carry money and no ID?

It's not at the stores discretion, it's actually mandated by state law. In Texas, TABC (Texas Alcoholic Beverage Commission) regulates who can sell & distribute alcohol.

A legal guardian who is of age, can provide alcohol for their minor child as long as they remain in the vicinity with their direct supervision. This also holds true for the case where a couple is legally married, and one person being of age while the other is still a minor.

The difference lies in the fact that your minor friends are of no direct relation to you, and are therefore seen as individuals who are unauthorized to legally obtain alcohol. I believe it's a misdemeanor offense, so therefore of course the store isn't going to allow a sale, unless you find a cashier who just doesn't care enough about their job and the possibility of getting fined as well.

Here they have signs up outside the liquor stores that say you have to be 21 to enter so that's why they won't sell it to you if someone is at the register <21...they aren't even supposed to be in the store.

And to the people bitching about not being able to buy liquor at the grocery store, at least you can buy beer/wine there...we can't even do that.

The LCBO by my place has a security guard that walks around the store checking ID and kicking out people who aren't 19. If you are underage you aren't even allowed in the store.
