Selling a used car Q

I want to sell my 96 Maxima. According to DMV CA I need to have a recent smog check certificate. However, when I called Carmax, they said if they buy my car I don't need to provide any smog check proof, since I already have registration for this year. Do I need to show a smog check certificate when I sell my car privately?
