within the United States itself; and

(3) Transfer to the Department of Defense core prosecutorial,
investigative, law enforcement, penal, and custodial authority and
responsibility now held by the Department of Justice.

Yet the Patriot act is law today and you can "legally" be held indefinitely without trial. The President of the United States can order the military to kill a US citizen without due process. You must submit to unreasonable searches in order to use the method of travel of the day and your communications can be spied upon.
