Legally, they have to pay you. You can just complain to the EEOC (equal employment opportunity commission) instead of getting a lawyer. They will then investigate, and you will not only get your back pay, but interest on it. If there is a no fault judgement, then you can hire an attorney on your own.

Someone is getting busted.......

I decided to call HR department myself and they just told me there isn't any problems with payroll and if I was turned in on time LIKE MY HR REP TOLD ME i would of gotten paid....

Well, here's how it is:

Just got off the phone with payroll and they told me that I'm in the system, but none of my timesheets we turned in.

I just talked to my HR rep and she told me that they were....go figure. So....I'm SOL or someone is fibbing.
 
Understand the anger, and you need to get paid, but, don't do anything you might regret. Jobs are tough to find these days... but... again, you are right to be angry--working for no pay is < doing nothing for no pay!
 
I would call Channel 4 news. They'll love to hear this story. Just have them digitize your face and voice.

I still remember your old post and can't believe you still did not get paid yet.
 
you should have a copy of the contract you signed. If you don't , I'm sorry. Check to see if you can get a copy or see the original. More emphasis on seeing the original. They might alter the photocopy.

To bad you are not protected by a union. My employer has 72 hrs after the end of the pay period to give me my check. After that, I get an extra 2 hrs for every 24hrs my check is late.

Of course, they have never been late.

If you eventually brought a lawsuit, I am sure your legal fees and paid time off would be included in the settlement.

That being said, there are a few important points that I've seen.

First, someone didn't turn in your time sheet. Whose responsibility is this? Raise hell until this person(s) is found and held responsible.

Second, the hourly wage. If you remember specifically what wage they offered you, find anything and everything that has it listed - job listing, contract, any communiques with the person that hired you. If you let this slide now, you'll never get it corrected.

Gonna find out Monday, my main boss is a real nice guy and I bet he made a mistake and will correct it......hopefully.
