So if a year is an acceptable amount of time to leave a critical arm of the government broken then why not two? three? four?

Here I thought presidents served four years turns out it is three years and then one year at the pleasure of the senate when it comes to supreme court nominations.

My life would be so much easier if I could just not do my job when it would be difficult like congress does so often.

The people spoke. They gave the separate, but equal, branch of the government control. Check and balance.
 
GOP made its bed. Now Obama gets to pick which group GOP will alienate for a generation. It's an important responsibility. I think Asians are the way to go, personally. A fast growing and affluent group that I could see swinging to Republicans over economic issues and affirmative action. Now is the time to nip that in the bud.

Well they certainly aren't doing the "check" part are they? I remember in school when I was taught about the three branches of government and their duty to block and balance each other. I also remember how it was important that Congress reign in the president when he abuses his power by doing what the Constitution tells him he is supposed to do./s

I get your point but 2 big differences. in 1992 there was already a working court. Also vacancy never happened so things moved on.

Now we have a dysfunctional court caused by a death. Just like a similar speech given by Chuck Schumer that he qualified with "unless there are unusual circumstances"

Death on a current court is unusual.

The breadth & depth of right wing bullshit slinging has been astounding, it's success quite remarkable. None of that would have been possible without some concerted effort to manipulate the so called Liberal Media which is not Liberal but rather sensationalist & corporate. Repubs provide the splashy & trashy headlines they crave & enough well timed innuendo to keep them onboard for as long as it can be made to last. It's something they perfected during Whitewater.

It's worked well enough that a prominent Birther is now considered to be a viable presidential candidate. It doesn't take much thought at all to see how utterly wrong that is.

Kudos to right wing propagandists in all of those "watchdog groups" think tanks & institutes. They're the best at what they do, worth every penny their big money donors give them. They've Benghazied America since long before there was Benghazi.

The court can function as is. If there were multiple vacancies I agree with you that it becomes increasingly dysfunctional. But in all reality dysfunctional is a matter of opinion. And the court can function right now in its current form IMO.

And there are really two ways a supreme court justice leaves. Death or resignation\retirement. Neither are unusual circumstances. So Schumer really said is we shouldnt confirm any Bush nominee. Because unusual would be something like multiple deaths. Death is not unusual. We have had 112 Justices and about ~45 of them have died while serving on the bench. Schumer is full of shit as usual.

That said I think the GOP should look at Obamas nominee. If he nominates a moderate that wont gut Heller move ahead with great vigor. If Obama nominates a bomb thrower move to the next President.

I'll say this, if this talk from the GOP is simply political grandstanding then so be it. The problem is that the GOP has, for the last seven years, backed up their rhetoric with actual action of inaction. So if the GOP actually go through with not even allowing a debate on a nomination then I suspect all gloves will be off and this period of time (Obamas presidency) will be noted in history as when US democracy started to fail.

Declaring you won't have hearings before nominations are made is not doing the job they were elected for.

This isn't checks and balances this is refusing to do their job. They can vote no until the cows come home but they should have a hearing, they should be putting their name down as a no vote on whoever Obama nominates. What they are doing now is spineless, they don't want to have to vote no when Obama nominates a moderate.

As for the "Biden Rule" crap show me a time such a rule was ever followed? Show me a time the court was left at eight for over 300 days? You can't because neither of those happened.

The media gave up on news back in the late 60s / early 70s, when they became for-profit.

Today the media is BothSidesDoIt™. They the stenographers. They report what both sides say, and then do their best to make sure that they don't "put their thumbs on the scale" by telling you who is lying, and who isn't.

The BothSidesDoIt™ media is in it for the cash, and the status.
 
There are at least 5, and probably 6, still sitting justices that care about the public perception and historical integrity of the court and are likely being pissed off to no end by this foolishness. Please proceed Republicans.

To be fair to the repub partisans--this current crop of imbeciles were elected explicitly to not do their job. Their only platform was to "block the president from doing anything." So, LK and his 8 year-old playground friends are correct: "the people" did speak wrg to electing this Congress.

I say it is worse than that. Our media has largely become a private run state media. For as much as the right likes to talk about the left wing media. That left wing media had no problem spewing out the lies of a Bush administration to convince the people we need to go to war for the next two decades. They have become a mouthpiece for the govt.
