As reported here, and many other places, Scott Peterson has been given the death penalty for killing his wife and unborn child.
Obviously, the jury saw the crime as a double murder, and thus a capital crime. I'm just curious as to what exactly the status of the fetus is in this case. Under Roe v. Wade (and many other rulings), a fetus isn't a legal being; under this case, it could be interpreted that way.
Did they argue that he didn't have consent to abort the fetus, or what? I'm not trying to start an abortion flamewar, I'm just confused by this.
