An HIV-positive inmate was convicted of battery today for spitting on two deputies during a scuffle in the Sedgwick County Jail.

A jury of seven women and five men convicted Michael Gaines on two counts of battery against a law enforcement officer.

One former deputy involved in the incident testified Gaines? spit hit him in the eye. The former deputy said he had to undergo treatments of antiviral drugs and six months of HIV testing to guard against the communicable and potentially deadly disease.

Gaines, 50, who initially had been in jail on robbery charges, faces sentencing on this conviction at 1:30 p.m. July 17 before Judge Rebecca Pilshaw.

because AIDS is transfered via SALVIA? So you are in serious agreement with 13 years? Not many are siding with the judge on this case at all.

well you are assuming that during the struggle there was no trauma to his mouth, gum or lips which would result bleeding.

struggling with two deputies in jail what do you think the odds are?

we are not talking about spitting on the sidewalk and someone falling in it 2 hours later scraping their knee....it was instantaneous from his mouth to the officers eye.

so you think that just because there has been no recorded infections or deaths because of this that it's ok? (how many people do you think would volunteer for such a test?)

You think that the courts should have waited until the deputy was shown to have an infection before they determined what he did was assault on a police officer with a deadly weapon?

Sorry, but this dude deserves it, just as if he was going around fucking women (or men...if he swings that way) and infecting them.

Hopefully he'll die in jail.

13 years was unjustified, also he was not unprovoked.

qft. These deputies were just pussies. The correct response is to bitch-slap the person who spits on you, and let it end at that. This whole 'run to mommy' syndrome is indicative of how weak we're becoming as a society, imho.
 
I'd be interested to hear if anything happened to the prosecutor. It's one thing for a (presumably) uneducated convict to start lobbing profanities at the judge/prosecutor. It's quite another for a guy with a law degree to engage him with taunts like "any time" and everything else he was saying.

no, I think you need to go back through the thread, and well, "everyone" does not seem to include the judge or prosecutor or jury.

like it or not he got the punishment he deserved...YOU have a problem with it and well, spouting off about it on some forum that is a grain of sand on the web is not gonna change it.

If you feel so strongly about it, perhaps you should divert your energy to a more beneficial purpose and strike up a penpal friendship with the man and let him know exactly how much you will contribute to his appeal fund.

Perhaps start a Paypal fund for him.

I'm sure once your friendship blossoms and grows he'll appreciate your yearly conjugal visit.

It's pointless to reply as you do not understand the argument you are in. Even the judge admitted she knew it was impossible. She likened it to using an unloaded gun in a robbery....

However, an unloaded gun is considered more criminal to brandish than a loaded one...a loaded gun can be defensive, an unloaded one only a threat.

Just to fill you in since you are getting all hostile and that.

I wasn't trying to change anything other than bringing up a pretty funny video.

However, while no one was disputing the crime (battery)...the 13 years he was given by the JUDGE is what you are missing. The jury didn't sentence him. The prosecutor wanted 10 years.

It makes no further sense for me to respond further to one that simply doesn't understand what they are defending.

This is what Wheezer and others are missing. Michael Gaines defense was this kind of taunting and abuse was regular and the whole cause of why he spat in the first place.

Yes, even he knew he was guilty of that. I know he was guilty of that. 13 years is the problem.
