In her decision, Koh quoted from the jury selection transcript, in which Hogan acknowledged that he worked for Seagate at one time. "Samsung's counsel expressed no concerns" about that fact, Koh said.
Samsung said it did not discover the lawsuit with Seagate until after the verdict, but Judge Koh basically accused Samsung of not doing enough research.
"Prior to the verdict, Samsung could have discovered Mr. Hogan's litigation with Seagate, had Samsung acted with reasonable diligence based on information Samsung acquired through voir dire, namely that Mr. Hogan stated during voir dire that he had worked for Seagate," Judge Koh said this week.

Samsung gets slapped down again. Thought this forum would like to know this news since there are a multitude of users who thought this would be a slam dunk. You can't expect to get a new trial just because you were too incompetent to do your own research during voir dire.

Judge Lucy Koh found that Apple had not adequately demonstrated that it would suffer irreparable harm if 26 Samsung devices were not pulled from the market.

On the damages front, Apple argued that $1.05 billion alone was not enough, but Judge Koh was not convinced. "Apple's licensing activity makes clear that these patents and trade dresses are not priceless, and there is no suggestion that Samsung will be unable to pay the monetary judgment against it," she wrote. "Accordingly, the Court finds that this factor favors Samsung."

Yeah she did. I think its a good thing. Even PC mag separated that news into another article here. Feel free to post another thread since it fits your agenda.

I'm trying to stay out of the arguement but find it somewhat entertaining.

You could have just picked one of the many ones that showed the double edged sword of the broken patent system in the first place.

The juror misconduct slant was a big issue talked about for quite a long time on this forum. Look here: http://forums.anandtech.com/showthread.php?t=2274389&page=4&highlight=juror+hogan . It was a slam dunk in a lot of peoples minds, especially if all they read was groklaw and reddit.

I dont see anyone talking about the product ban as much as the juror misconduct (or lack thereof)

He could have but cheezy doesnt work that way. He just loves trolling using his fandom of all that is apple to serve his adrenaline need.

The real discussion IMHO is whether or not you feel the guy should have been on the jury. Going by his past, I don't he should have been anywhere near that case. But it is what it is.

I agree. But, being that it is what it is, I think samsung should just move on. Apple has been touted as a dickhead company and the fact that apple is losing every where else in the world can only be good for samsung. its like samsung doesnt even have to try anymore to make apple revealed as the shit company it is, apple is doing it all by themselves.

Meaningful discussion to you must consist of:
-Judge Koh being a paid shill (or an apple fanboy)
-there being some 'hometown advantage' for apple
-the foreman being out for revenge
-the foreman 'tainting' the trial

I would rather speak about real things that actually happen in these trials versus made up nutjob theories from the android herd.

The bias of Judge Koh and the state of California have been shown repeatedly to be in favor of Apple. This isn't surprising really. There's easily enough evidence to have an entirely new trial, but that be in a court that was actually neutral.

Yeah, we'll see which 9th Circuit panel gets this appeal... or will it go to the Federal Circuit?

EU will charge Samsung 'very soon' in Apple antitrust case

European Commission Vice President for Competition Policy Joaquín Almunia says the EC will charge Samsung for its use of injunctions against Apple in Europe "very soon," according to Reuters. The commission has been investigating Samsung for a possible breach of antitrust rules since January, and earlier this week the Korean manufacturer dropped all of its injunctions (and injunction requests) against Apple products in Europe.
