Their point is Apple's lawsuit against them is ridiculous because if you look back, there's always a similar looking device that came before yours.

Dailytech covered it as well. What I found funny was that Apple claimed Samsung's F700 music player was copied from the iPhone but they had to retract that claim after they found out that the F700 was released in the public view (Cebit 2006 (Mar. 2006)) before the iPhone was unveiled (Macworld January 2007).

oh great, another one of these threads

While I too tire of these copy threads, I thought this accusation merited mentioning as it involves sony, who, for the most part, stayed out of this.

Considering some iPhone prototypes had Sony logos on them there may be some truth to it.
Thats a drawing by an apple engineer as to what they thought, from the descriptions they had, the Sony device may look like.

But its still pretty damn close to what the iPoS ultimately looked like and would seem to still be pretty damning evidence against Apple's case.

The prototype never made it to production and the actual iPhone we have today looks nothing like Sony's. And yeah another one of those threads. Enjoy your devices people.

From the DailyTech article:
Samsung believes the design was not directly stolen from Sony. Rather, "in February 2006, before the claimed iPhone design was conceived, Apple executive Tony Fadell circulated a news article to Steve Jobs, Jonathan Ive and others. In the article, a Sony designer discussed Sony designs for portable electronic devices that lacked buttons and other 'excessive ornamentation,' fit in the hand, were ‘square with a screen’ and had 'corners [which] have been rounded out.'"

So let me get this straight...
Sony said they were designing a device that was rectangular, had rounded corners, and "minimalist" in design.
Apple then uses these concepts in its iphone design; and is now suing Samsung, citing that their phones resemble the iPhone because of those characteristics?

wow.

/popcorn.

That seems to be what Samsung is alleging, yeah.
Welcome to Apple's world.

In order for it to count, I think you have to be first to patent or first to market.

I could care less about apple vs Samsung. But "prior art" means apples patent is not valid.

Exactly, You can't sue a company releasing hardware that somewhat looks like it could be kind of inspired by your device, when in reality you basically completely stole the exact design of mockup developed by another company by hiring the guy who developed it.

I mean its a dead ringer for the Iphone 4. It's almost obvious that it was the design that they wanted in the first place, they probably feared if it was the initial look, Sony was going to go crazy. So instead they waited till people had forgotten it and then released it as the the 4.

Now you could say Apple was first to market and it might be to late for Sony to do anything about it. But all Samsung needs is prior art to prove that they didn't develop the style and it becomes a Sony vs. Samsung issue, which again Sony might not be able to do anything. Basically by stealing that directly from Sony, Apple may have not only invalidated any design patents at least pertaining to the 4, but open up that design for the rest of the world.

Does this mean I can dig out a white rectangle I drew in second grade and sue Apple for copying me? Score!

Apparently. Until apple has one of their "geniuses" draw another picture and modify the file date prior to your picture.

Oh ok, I see what this thread is. Made to trash apple, not actually discuss the situation at hand involving Sony.

Haters: feel free to continue your childish discussions about rectangles and other nonsense.

That's a fairly serious accusation with some serious ramifications. Do you actually have any evidence to suggest that this is true or are you just making wild speculation?

Then why even bother posting something like that? It doesn't add anything at all to the thread and only serves to detract from any meaningful discussion about the topic. I could understand if you were just posting a rumor from another source, but if it's just something that you've made up or otherwise know to be completely baseless, there's really no point to it.
