Lawyers are expensive... $150 per hour. It would take about $300 on average for a lawyer to write it up. Better to just record it and send it to the AG and phone company. If that doesn't work, then actually sue.

Yeah, I had the same problem- come home from work, one message per day from a collections agency about a guy that couldn't have ever lived there simply because the building's four years old and the previous tenant was there for those four years. Oh, and I know the last tenant. Useless idiots. They eventually stopped when I yelled at them.

Oh, and once a week, I get a 7:45am call from a beer delivery company who will not learn that my apartment is not a pub and does not need a beer delivery. Every week.

[Edit] Record a really loud belch or fart. Call them up and play it on loop at them. Repeat.

Yeah, sometimes I'll get some rogue agancy calling my house for someone else. I usually just ignore those numbers and let the machine pick it up, and they eventually give up.

Lately, however, I've been amused at this one place, (I told them they had the wrong information the first 2-3 times they called) who apparently owns about 10 different numbers they use to call. I mean, they all have the same 3 digits in them, but they are in different places - and the caller ID reports different, yet completely generic, names associated with them.

They show up as:

123-xxx-xxxx - "Collection Agency"
xxx-123-xxxx - "High School FFA"
xxx-123-xxxy - "XYZ Pictures"
xxx-123-xxxz - "Football"

But they leave the exact same message each time - do people who screen collection agency calls "fall" for that and accidently answer when they see "High School FFA"? :confused:

Update: The calls have continued since my original post. I've received 5 more, and I have the dates and times documented -- as well as a record on my caller ID.

I called them back AGAIN and told them to remove me, and again they promised they would. The FTC replied back that there is nothing they can do unless I file suit against the company in court under the FDCPA act. My State AG has not contacted me. The FCC has not responded either. The last call was last night, but they have not called back since then.

Anymore suggestions? I am really hesitant about wasting time and resources to file suit, but this is beyond ridiculous.

You could tell them that you are in bankruptcy and it's illegal for them to call you anymore... give them the name of a local bankruptcy lawyer and tell them to discuss it with him.

And as Ross Perot would say, problem solved. ;)

Call the phone company and the police. Phoen company might be able to block the calls, police can charge them with harassment.

Or get a phone system that you can block calls from certain numbers. Or get an air honr and when they call again, just answer the phone and blast them.

I wouldn't even hesitate to contact a lawyer specializing in this sort of thing. If he says don't bother, then do something else. But until you get an expert opinion you're just wasting time and frustration.

In Washington it's $100,000 per spam email or solicitation.

Go to Clarkhoward.com and look into the section on debt and there are few suggestions you can do. Also search "collections" etc etc on google.

Basicly if you tell a credit collection company not to call you then by law they have to stop calling you. You could also get an address and send them a "stop contact" leter and they can no longer call you.

If you sue you can collect up to $1000 plus court and attorney fees, so calling a lawyer might not be a bad idea. Most give free advice, might take case with no money upfront looking to collect their fees if they win.

Most Important Record your phone calls with them. Set up your answering machine to not hang up when you pick up the line.

And then say something like:
"I am asking you not to call me again, under the federal Fair debt collection practices Act you may not contact me after me asking you not to. If you continue to contact me I will call the Attorney generals office of my state and hire a lawyer to sue you for harassment."

Try to get their address before you pull that line though so you can send a "stop contact" letter.

Yep. That's exactly what they think will happen. Our second mortgage is due on the 10th, and all my jobbers pay me on the 15th. So we pay on the 15th every month. Doesn't cause any late fees or anything.
The second mortgage company will call on the 11th....every single month. Recently, they've been calling from different numbers and some of them even come up as different individual's names. But they leave the same message, if they leave one at all.

I think, short of contacting a lawyer, that the best thing you can do is thus:

After the debt collector's initial schpiel, inform them, again, that they have the wrong number, and are welcome to verify that information in the local telephone company's reverse lookup.
Inform the person that you have instructed them repeatedly to cease calling and they are now in violation of Section 804, subsection 3 of the Fair Debt Collections Practices Act.
Further state that you do not wish to be called again.
Let them say something stupid, like "if you don't want us to call, pay the debt."
Inform them that you have been recording the call in its entirety.
Ask to speak to the supervisor. (They have to comply with that)
Inform the supervisor of everything above.
Reiterate, again, that you do not wish to be called.
Hang up.

If that doesn't work, it's lawyerin' time.
