Roomates who dont pay rent. what to do?

Below issue was resolved. thanks posters.
We threatened her with legal action (nothing specific, literally "legal action") and she caved. she'll be moving out in < 15 days.

However, I still would of liked to throw her crap out, punch her in the face, and sell her valuables online. Maybe hire a ninja to finish the job. But no, you guys are all like "VT CODE 234253 - thou shalt not hire ninja's to kill tenets with or without lease agreements or dispose of decapitated bodies."
So that was scratched from the 'options' list.

Thanks again.

I need some help people.

My roommate and I have a third who has apparently decided to not pay rent this month. It was due the 1st. We've tried time and time again to talk to her, and she ignores us, attacks us, and is avoiding us all around.

Our land lord has threatened eviction. Our current solution is such:

Change locks on the doors, tell her to pay up, or we'll be forced to take legal action.

I'm not looking forward to paying the extra rent, and I hate to go so far as to hold all her belongings as hostage (outside of giving her some clothing if she so requests it), but am out of ideas of how to resolve this peacefully. This is creating a large amount of stress, and just making things difficult for everyone.

Has anyone had to deal with this before, do you have any suggestions on a better way to handle it? We've tried for the last 10 days to talk to her, and she simple ignores, or attacks us. It's been virtually impossible to corner her. Going to change the locks in one hour.

Thanks people.

change locks, sell her stuff to cover costs. If she's going to be an immature little brat, she should be treated as one.

Are you all on the same rental agreement as all paying $x every month, or do you have individual agreements?
I'd assume it's #1 otherwise I wouldn't imagine this being your problem. Have you spoken to the landlord/management about changing the locks before you do it?

If her name is on the lease, I'm not sure you can just kick her out like you should be able to, might make you go the legal route because of that

Contact a lawyer.

Taking her property hostage is most certainly illegal. Also, just changing the locks with her name on the lease is most certainly illegal as well.

Again, contact a lawyer

Agree. with Lonyo. If the 3rd person isn't on the lease, it's not the landlords problem and he can kick you all out. Although, still not having the complete amount of rent is still probably a problem. And yes, usually you have to let the landlord know about changing locks and he must have a key.

1 - two girls, one guy.
2 - lol, i don't have pics
3 - she's actually not on the lease. which is for better or for worse.
4 - she's never had any issues with paying before, she's not gotten along with the other girl i live with, they seem to clash every so often.
5 - we have not spoken to the land management about changing the locks. we're not to worried about that end of it. Where I live, its sort of slumming it.
6 - we have considered selling her stuff on CL in case she doesn't pay. But would rather not.

Use 1 month of her 2 month's security deposit to pay for this month and give her a few days to refill the security deposit.

Over 1/3 of a month's rent?

This is ATOT, everyone recommends getting a lawyer over any insignificant amount of money. Amazingly, I've gone my entire life without ever needing a lawyer except to handle the purchase of my house. These guys use a lawyer when a vending machine eats their money.

She's not on the lease. Put her shit outside, change the locks and say good riddance.

lol, 2 months security deposit? man, not sure where you live, but we deff dont do stuff like that around here, its usually 1 month...or even less, like 1/2 month. so it won't cover it.

OP made no mention of the roommate leaving after this month. So not only is the OP going to have to fork over that roommates share of the rent so he himself doesnt get evicted, but this seems to me like a pattern that will continue indeffinately. Contacting a lawyer to get it resolved now will probably save him money and hassle in the end.
