Double jeopardy does not only apply to being acquitted. It also applies to being convicted. You cannot be tried and convicted twice for the same crime. The only possible "retrial" would be for the sentencing.

Should there be another trial and another sentence beyond the one agreed to, he would be tried again after being convected, and a possible second punishment enacted. Both are forms of double jeopardy.

Even redoing the sentencing would likely be immediately struck down on appeal since there is clear evidence that the judge had agreed to a plea and begun executing the sentence.

No. He should have paid for the crime. The justice system screwed up royally and it would be highly unethical for him to be sentenced to jail for that particular crime. I wish he were rotting in jail due to a fair and reasonable trial. But he isn't, so as a person who believes in the law I have to be happy with the thought that he had a horrible life and probably is a miserable human being and not wish for illegal further imprisonment or punishment for this crime.

I do wonder why he wouldn't be prosecuted for fleeing the country, though.

Btw, the chick made a public apology to him a long time ago. This is a very one sided story and post. From my sources, here are the facts:

He did have sex with an underage girl
She looked much older
Sex was pre-meditated
At the time Polanski was very famous in the States
There was an orgy at Jack Nicholsons house

The victim in the case, who is now 45, also has filed court papers calling for charges against Polanski to be dismissed.

Saying the publicity that surrounds the case is hurting her and her family, Samantha Geimer wrote that she would appear in court to seek the dismissal even if Polanski does not.
