RoadRunner blocking use of Kazaa?

Shamelessly ripped from /.

"...RoadRunner is quietly blocking the use of Kazaa in certain markets. Particularly in Texas, they have some sort of port scanner in place which scans for Kazaa activity and then disables use of that port, rendering the program completely useless. Grokster, iMesh, and all other FastTrack programs are similarly affected. Yet RoadRunner is not disclosing the practice in any way. Not only that, I'm troubled by the possibility of them arbitrarily choosing to block other programs in the future. If this becomes more widespread, they will have many angry (and former) customers..."

Roadrunner is owned by AOL/TW, a member of both the RIAA and MPAA.

I have Speakeasy sDSL, and they explicitly state in their ToS (Terms of Service) that they do not block ports, and that it's perfectly ok to run servers. They state that as a policy they sell you bandwidth, and it's up to you to use it how you see fit (they except hacking attempts from that, and I'm not sure about the copyright issue).

Cable companies want to sell you bandwidth that you won't be able to use. They want you to be able to say "ooh, that webpage loads so fast" or "ooh, my download of Approved AOL/TW Media Content goes so fast!"

I think that they should be allowed to block ports, but... (1) there needs to be competition in the market, so that people can choose to migrate to another service which does not block ports, and (2) they need to explicitly state in their ToS that they are preventing you from using certain services available on the internet. They also need to word it in such a way that most non-technical people will understand it; how many of you have grandmothers who know what a TCP or UDP port is?

Astaroth33,

It wouldn't matter how they worded it. Most people do not read the TOS agreement.

Good point.

They are legally obligated, I believe, to disclose that information in the TOS, regardless as to whether most lay people will ever actually read it.

No problems for me up here in NY. Actually, I have 66 Kazaa downloads going right now. If they try any of that bandwidth usage limiting or blocking ports DSL is only a phone call away.

InsightBB is looking into stopping this stuff too. It's not because of copyright infringement, it's because it adds an outrageous amount of traffic and requires more nodes. When college is in here, ping times for the whole damn town can go through the roof, and this isn't just peak hours either.

All their machines become virtual servers, and are constantly sending and receiving packets.

Our local InsightBB office views Kazaa, or any other file share users as running a server, which is against their TOS.

And for a non-file sharing, online gamer like myself who gets pissed at outrageous ping spikes, I can't say this upsets me very much.

I have to agree, When the cable company sell that HUGE pipe they don't intend for you to use it at full bore, all the time. My DSL said I could run a server but then again my bandwidth isn't shared. The only thing I would use the server for would be to distrute pics of the kid but I just use the 5MB webspace it's just faster. ALso IF the RIAA wants to go after roadrunner or any ISP for that matter, you will see accounts being canceled very quickly.

^^^ True. And knowing Time Warner, they'll pull the plug on your service and then cold call you the next day touting how Roadrunner is great, asking you to subscribe again.

This, IMO, is correct. The quality of the mp3's on Kazaa is so bad that it is little different than recording off the radio.

aren't ISPs done the same way that phone companies are, that they are not liable for traffic over their network? of course, thats the criminal side of it, and RIAA could just try to do it as a civil suit. of course, an RIAA member is the cable company... i think theres two other ISPs to choose from here in austin, earthlink and a small one. might have to xfer my service to one of them if rr starts blocking ports.

the whole point of having cable/dsl is for download speed..........if kazaa or winmx NEVER existed do you think you would have sign up for the service in the 1st place

I've often used it kazaa to download legal files. And I'm not talking semantics here about MP3's or something. Not everything on kazaa shared is illegal to distribute.

if file sharing didn't exist I would still have broadband, the page loads and legal download speeds are worth it to me. I hope they relize that by filtering some content its making them liable and open for lawsuit for other content...

I had cable before I heard of Napster. The only thing I knew of was newsgroups.
