1) Personally, I don't believe you have the card yet. If you do have the card, and there is nothing wrong with it, suck it up buttercup, you're not getting an RMA for no reason. They'll just send you the same card back.
2) If you did overclock it
3)If you do RMA it anyway, be happy with the knowlege that you're trying to rip the company off, and help screw over every other customer that has a valid RMA.

like you claim, then the warrenty is VOID. You should not RMA it, and they should not honnor it.and it doesn't overclock anymore (sometimes I have to underclock it)
