RMA Dilema.. Who's fault is this?

Ok, before i go through the process of trying to RMA this, let me explain my problem.. I recently built a system for an associate, Abit KT7-RAID, Duron 800... (Those are the only 2 relevant pieces).. Anyways, today he brings it back to me saying it made a burning smell and its dead...

So I open it up, I find the heatsink is OFF the cpu, laying on the bottom of the case.. Then I notice that the socket A plastic clip that holds the heatsink on is snapped off.. So, the motherboard socket was essentially defective, it snapped from the pressure of the heatsink pulling on it, and the CPU then died..

So I have 2 problems, first of all, whose fault is this? Its still all within the retailers 1 year warranty.. DO you think they will give me any hassle on this? Clearly the motherboard was defective and caused the CPU to burn out.. I think the motherboard is fine other than the CPU being toast, and I think if I could get them to replace the CPU, and find one of those heatsinks that use the other 2 clips on the socket 7 to hold it on.. but what if it happens again? SHould I have them replace the entire motherboard and CPU? THat would probably be the best choice I think... but probably the most hassle..

Anyone else ever hear of this happening? I think because its within the 1 year warranty the retailer should have to replace it, and then THEY can argue with Abit on if they should be responsible for the CPU blowing out..

Hate to be the one to break this to you but you'll be lucky if Abit will even replace the board. They'll probably blame you or the HSF for breaking the plastic clip. Even if they do fix/replace the board they won't replace the Duron. Luckily it was only a Duron. It could be worse.

I know it sucks..

Well, the good thing is that its still under warranty from the place I bought it from, so I would expect THEM to replace it.. And I bought the fan THEY recommend, so they can't blame that..

Ive had this happen, it really sucks. I superglued the little plastic thing back on hehe and sent back the cpu.
