From slashdot. The RIAA is asking for trillions, BP will probably get away with a fine of tens of millions.

Some of the comments are pretty great too.

Also, unless my inflation adjustments are wrong, 1.5 trillion in 2009 dollars is Four Times the value in 1921 dollars of the war reparations imposed on Germany by the Treaty of Versailles.

Yup, being a third-party facilitator to some file-sharing is four times as evil as WWI...

While we are talking about putting that value in perspective, 1.5 trillion is just over 10% of the US GDP in 2008.

The idea that Limewire somehow owes damages equivalent to 1/10th of an entire year's output of the economy of the United States boggles the mind.

To put that number in context: There are currently 8 countries on Earth [wikipedia.org] with a GDP higher than that.

The RIAA claims that if it wasn't for those meddling Limewire, they'd made more money than the entire population and industry of Canada in a year.

If they could also collect the trillions from Napster Kazaa and other torrent sites they would pretty much have control of the whole alpha quadrant!

HA HA HA AH AHA AHAHAHA.

This should be enough for ANY judge to say "You guys are full of crap" and throw out any case they could ever make. Seriously, they really think that they have lost more money then ANY company in the history of the US has made in a year? And do they actually believe they can some how extract that money from anyone?

1. Fvck the RIAA.

2. Just a legal point. They aren't suing for compensatory damages. IIRC, federal copyright law allows punitive damages quite a bit higher than just compensatory damages.

3. A case like this may provide justification to get the copyright punitive damage law declared overturned.

I thought there was a Supreme Court ruling which said that punitive damages are unconstitutional if they exceed compensatory damages by a factor of more than 4.

Edit: The demand for $1.5 trillion is completely frivolous.

http://en.wikipedia.org/wiki/Punitive_damages#United_States

"There is no maximum dollar amount of punitive damages that a defendant can be ordered to pay. In response to judges and juries which award high punitive damages verdicts, the Supreme Court of the United States has made several decisions which limit awards of punitive damages through the due process of law clauses of the Fifth and Fourteenth Amendments to the United States Constitution. In a number of cases, the Court has indicated that a 4:1 ratio between punitive and compensatory damages is broad enough to lead to a finding of constitutional impropriety, and that any ratio of 10:1 or higher is almost certainly unconstitutional.

In BMW of North America, Inc. v. Gore (1996), the Court ruled that punitive damages must be reasonable, as determined based on the degree of reprehensibility of the conduct, the ratio of punitive damages to compensatory damages, and any criminal or civil penalties applicable to the conduct. In State Farm Auto. Ins. v. Campbell (2003), the Court held that punitive damages may only be based on the acts of the defendants which harmed the plaintiffs."

That's actually my hope, that the abusive tactics of the RIAA actually become egregious enough that the laws get turned against them.

But I'm not holding my breath.

Edit: Oh, and: Fuck the RIAA.

I'm guessing that they're trying to make the "piracy is wrong" point again, but with a number that ludicrous, they've just failed. Horribly. No way in hell ANYONE is going to take them seriously.

I think they're going for threatening, but are mistaken because their numbers are so high that it reached comedic levels.

Threat levels:
Not bad
Reasonable
Not good
Uh oh
Oh shit
WTF?
This is a joke right?
