"Malpractice" reform is a misnomer. It is simply a cover to limit the liability of the crappy 10% of physicians and hospitals who commit over 50% of medical errors.
I don't buy the 'defensive' testing argument, either. If a 'test' is reimbursable by BigIns or the gub'mint, I'll wager that a significant percentage of testing is done to generate revenues, either within the specific health system network or to an entity in which a physician has a financial interest.
If you want 'reform,' shine the light on substandard physicians and hospitals, and let the 'market' seek care elsewhere.
